A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister decided to maintain the refusal of Planning Permission

Reason(s) for Decision:

A site visit was undertaken on request of the Minister following the Ministerial meeting to evaluate the proposal further. Following this evaluation, the decision to refuse was upheld for the same reason for refusal as given on the Decision Notice. Namely that ‘Notwithstanding the inadequacies of the existing access to Little Manor, the proposed new access is considered to be contrary to Policies G2(vii), (viii), G3 (vi) and G13 since it does not provide a safe means of access and egress to the property and would lead to unacceptable levels of road safety. In addition the loss of the granite boundary wall and creation of a much wider access would affect the character and setting of this and the adjacent Registered buildings’.

 

The Minister recommended that if the entrance was relocated and agreement could be reached with the adjacent neighbour at Les Alpes to lower an adjacent wall to improve visibility into/out of the site, then in those circumstances if a fresh planning application was submitted then permission may be given.

Comments on Case

The applicant states that:

a)     Both Historic Buildings and T&TS have avoided answering my new comments on their main objections and simply refer back to previous comments. Not considered fair treatment.

b)     The existing entrance has been given insufficient attention as it is a dangerous access. No officer has attempted to drive in/out of this entrance to demonstrate this. The new entrance will be much safer than the existing access.

 

 

 

 

 

 

c)      The original character of the wall has already been compromised as was formerly more open and has since been doubled in height.

d)     No other property on this part of the road has this sort of restricted access.

 

In response:

a)     Historic Buildings and T&TS have not commented further for this RFR as they have previously provided detailed comments and they believe that no evidence has been provided to alter these views.

b)     In depth CAD and photo diagram studies have been undertaken in this assessment by T&TS and along with site visits, a site meeting and comparison with the existing access have highlighted that the proposed access does not provide a safe means of access and would lead to unacceptable problems of road safety and does not improve on the current situation.

c)      Historic Buildings have advised that the loss of this characteristic wall and creation of a new access would be harmful to the character and setting of the Building of Local Interest. The applicant states that there used to be a lower wall originally creating a more open aspect, but this proposal differs from that original position by resulting in the loss of a significant stretch of wall and so would not be representative of this original situation.

d)     This has no bearing on the consideration of this RFR. It should be noted that T&TS would support the application if the nib wall between this site and the property to the south, Les Alpes, were to be lowered as this would improve offside visibility (and nearside visibility for Les Alpes) Although this appears not to be possible at present as the owner of Les Alpes will not agree to this.
