Crematorium: Proposed Charges for 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Proposed Crematorium and Associated Charges for 2013.

 

Decision(s):  The Minister requested the Law Draftsman prepare an Order to increase cremation fees by 2.5%. The Minister also agreed to increase books of remembrance and memorial cards charges by 2.5%. The proposed increases would take effect from 1 January 2013.

Reason(s) for decision:

The proposed increase in charges is in line with the RPI of the 3rd quarter 2012.

Resource Implications:

Charges for cremation, book of remembrance and memorial cards will increase by 2.5% from 1 January 2013; there are minimal administrative tasks to carry out but no resource implications.

 

Action required:

  1. On receipt of that approval, to instruct the Law Draftsman to prepare the necessary Order.

1                   Background

 

1.3           The Crematorium charges for 2012 were approved by Ministerial Decision ref. MD-HSS-11-0058 (copy attached in Appendix ).

 

1.4           From 1st January 2012 the cremation charges were increased by 10% to reflect the significant increase in gas to fuel the incinerators and the book of remembrance and memorial cards were increased by 2.5% in line with RPI.

 

2                   Present

 

2.3           The Minister is now required to approve charges for 2013 for an Order to be drafted under the ‘Cremation (Jersey) Law 1953’.

 

2.4           It is recommended an increase of 2.5% is added to the present cremation charges and remembrance fees for next year.

 

2.5           It is therefore recommended that cremation charges are increased from £600.00, to £615.00 an increase of 2.5%. Increase in the charges of 2.5% for the book of remembrance and memorial cards are detailed in the tables below.

 

3                   Recommendations

 

3.1 Cremation fees:

 

The Minister for Health and Social Services approves the fees as set out below under the provision of the Crematorium (Jersey) Law 1953.

The Minister is recommended to request the Law Draftsman to arrange for the preparation of the necessary legislation to give effect to the variation in the fees from 1st January 2013.

 

3.2 Books of Remembrance and Memorial Cards:

 

The Minister is further recommended to approve the following charges for the Book of Remembrance and Memorial Cards which have been increased by 2.5% rounded up to the nearest 5p: -
