Community Provisions (Restrictive Measures - Syria) (Amendment No. 10) (Jersey) Order 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Community Provisions (Restrictive Measures - Syria) (Amendment No.10) (Jersey) Order 2011

Decision(s):   The Chief Minister, in pursuance of Article 2 of the European Communities Legislation (Implementation) (Jersey) Law 1996 and having regard to Council Regulation (EU) No. 36/2012 concerning restrictive measures in view of the situation in Syria, made the Community Provisions (Restrictive Measures - Syria) (Amendment No.10) (Jersey) Order 2013.

Reason(s) for Decision:  

The Community Provisions (Restrictive Measures - Syria) (Jersey) Order 2012 provides for restrictive measures in view of the situation in Syria, equivalent to Council Regulation (EU) No 36/2012 as amended.

Council Regulation (EU) No 325/2013 of 10 April 2013 introduces a new prohibition concerning financial assistance relating to goods and technology and limits access by Syrian carriers to airports in the European Union.  It also introduces additional derogations in relation to the sale, supply, transfer or export of equipment which might be used for internal repression and to the provision of technical assistance.

The Community Provisions (Restrictive Measures - Syria) (Amendment No.10) (Jersey) Order 2013 gives effect to these provisions in Jersey.

Resource Implications:  There are no manpower or resource implications arising from this Order.

Action required:  

The Chief Minister’s Department shall –

(1) inform the Assistant Greffier of the States and the States Greffe Publications Editor immediately the Order is made.

(2) deliver the signed and sealed order to the Publications Editor.

Explanatory Note

This Order gives effect in Jersey to Council Regulation (EU) No. 325/2013 of 10th April 2013 (O.J. L102, 11.4.13, p.1). That Regulation amends Council Regulation (EU) No. 36/2012 concerning restrictive measures in view of the situation in Syria. The main effect of those amendments is to insert a new prohibition concerning financial assistance relating to goods and technology and to limit access by Syrian carriers to airports in the European Union. Those amendments also make further provision in respect of derogations from the prohibitions contained in Council Regulation (EU) No. 36/2012.

THE CHIEF MINISTER, in pursuance of Article 2 of the European Communities Legislation (Implementation) (Jersey) Law 1996, orders as follows 

1 Interpretation

In this Order “principal Order” means the Community Provisions (Restrictive Measures – Syria) (Jersey) Order 2012.

2 Article 1 amended

In Article 1 of the principal Order, in paragraph (a) of the definition of “Council Regulation” for the words “30th November 2012” there are substituted the words “12th April 2013”.

3 Article 2 amended

In Article 2 of the principal Order for paragraph (4)(d) there is substituted the following sub-paragraph 

“(d) Article 18(2) is omitted;”.

4 Article 4 amended

In Article 4(1)(a) of the principal Order 

(a) after the number “3,” there shall be inserted the number “3a,”;

(b) for the words “or 26” there shall be substituted the words “, 26 or 26a”.

5 Citation and commencement

This Order may be cited as the Community Provisions (Restrictive Measures – Syria) (Amendment No. 10) (Jersey) Order 201- and shall come into force on the day after it is made.
