This report supersedes the report dated 15 May 2007. It has been amended to correct an error in the description of the house which it is proposed will receive the parcel of public land. As the original report contained a factual error, it is necessary for the Minister to rescind his decision MD-PH-2007-0046 dated 24 May 2007, and to issue a new decision which will remain unchanged, save for the correction.
Sydney Crill Park estate was completed by the then Housing Committee in mid 1993 with the individual dwellings being sold off to first time buyers and the roads, pavements and communal landscaping remaining in public ownership (now administered by Property Holdings).
To the rear (east) of N° 52 Sydney Crill Park is an area of communal garden in public ownership measuring approximately 265 sq ft (approximately 20’ 11” x 12’ 8”). The owner of 52 Sydney Crill Park – Ms Sheelagh Elaine Greene – has requested the opportunity to purchase the area of land to extend her rear garden. The area of land is not especially significant to the landscaping of the estate, being set in a corner position behind two car parking spaces.
Property Holdings and Ms Greene have agreed in-principle terms for the sale of the land subject to Ministerial approval and States’ notification. Ms Greene is willing to pay £5,000 for the land, with each party to meet their own fees in passing contract. Property Holdings considers that the sum of £5,000 is a fair and proper price for the area of land to be used as a domestic garden, and compares with other similar sales in recent years.
There is a low level brickwork wall to the east and south sides of the area of land, which it is proposed would become a party owned wall as part of the sale to Ms Greene.
It is also proposed that the sale would include a clause in the contract which would prohibit any extension of the house onto the land or any other buildings.
Recommendation
It is recommended that the Minister agrees to sell to Ms Sheelagh Elaine Greene an area of land measuring approximately 265 sq ft adjoining to the rear east of her property, 52 Sydney Crill Park, for the sum of £5,000, with each party to meet their own fees. The sale is to include that the dwarf wall to the east and south of the land will become party owned, and for the use of the land being sold to be limited to domestic garden.
