Road Traffic (St. Mary) (Jersey) Order 2000: Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST MARY) (JERSEY) ORDER 2000

 

 

Purpose of the Report

 

To amend the Road Traffic (St Mary) (Jersey) Order 2000 by Article 68 notice to introduce a 12 hour “Maximum Waiting Period” and extend an area of “Prohibition of Waiting” on La Rue de la Rosiere.

 

 

Background

 

Amendment to Schedule 1 “One-Way Traffic Routes” of the Road Traffic (St Mary) (Jersey) Order 2000

 

As part of the St Mary Village improvement scheme the Connétable of St Mary requested that a section of La Rue de la Rosiere have a new time restriction on the permitted waiting period on the road.  As such a 12 hour in 24 hour parking restriction is to come into force.

 

Additionally a short section of currently unrestricted parking is to be restricted across the vehicular entrance to the Garage by linking two existing sections (See Map 1).

 

 

Discussion

 

Further restriction of parking in La Rue de la Rosiere is to be defined as below.

 

Amendment to Article 2 – Prohibition of Waiting

 

La Rue de la Rosiere: - East Side (from the southern boundary of the property known as Adison to its junction with La Rue des Buttes)

 

The Parish Order needs to have two articles inserted into Article 4 to define the maximum permitted waiting period.  Additionally a new schedule is required to list the new restrictions permitted by the introduction of the new articles.

 

Amendment to Article 4 of the Order – Prohibition of Waiting and Stopping

 

Inserted after Article 4(2) are Articles 4(2A) and 4(2B)

 

  • 4 (2A) A vehicle shall not wait on a road specified in the first column of Schedule 4 for a continuous period in excess of any continuous period specified opposite the name of the road in the second column of that schedule.

 

  • 4(2B) A vehicle shall not wait on a road specified in the first column of Schedule 4 for periods totaling more than any total specified opposite the name of the road in the second column of the schedule
