Our Hospital, Overdale Site - Planning Application (P2021/1670): Public Inquiry and Appointment of Inspector

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Public Inquiry: P/2021/1670 (Our Hospital Project).

Decision(s):

  1. The Minister decided to call a public inquiry into the development of the Overdale site for the purposes of a new hospital as part of the Our Hospital Project; and
  2. The Minister appointed Philip Staddon BSc, Dip, MBA (Distinction), MRTPI as the inspector to conduct the inquiry.

Reason(s) for Decision:

  1. In accordance with Article 12 (1) (a) of the Planning and Building (Jersey) Law 2002, as amended, the Minister is satisfied that the proposed development would be likely to have a significant effect on the interests of the whole or a substantial part of the population of Jersey. Additionally, in accordance with Article 12 (b) of the Law, that the proposed development, were it to be carried out, would be a departure (other than an insubstantial one) from the 2011 Island Plan (revised 2014).

 

  1. As required under Article 3 of the Planning and Building (Public Inquiries) (Jersey) Order 2008, the Minister shall appoint an inspector to conduct the public inquiry.

Resource Implications:

There will be a financial cost of the inquiry which will be borne from within existing budgets.

Action required:

  1. Having appointed the inspector, the Minister shall make a formal announcement as to the manner in which the public can engage with the inquiry. (Media Release & letters to interested parties required); and
  2. The Department shall arrange an inquiry website, email / postal address, and administrative support for the inspector.
