Amendments to the Road Traffic (Trinity) (Jersey) Order 1998 - Les Ruelles.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES

 

ROAD TRAFFIC (TRINITY) (JERSEY) ORDER 1988 - AMENDMENT  

 

 

Purpose of the Report

 

To improve traffic safety on a road junction in the Parish of Trinity

  

Background

 

During a recent meeting between an officer of this Department, the Connétable of Trinity, the Chef de Police of Trinity and the Head Teacher of Trinity School discussion took place regarding the forthcoming replacement of the current 30mph speed limit with a part time 20mph speed limit.  It was also decided to request the Minister for Transport and Technical Services to make Les Ruelles, which runs adjacent to the school, subject to a one way restriction in an easterly direction.

  

Discussion

 

The reason for this request is due to concerns that Les Ruelles joins La Route de la Trinite at a steep angle with zero visibility onto the main road, thereby causing a danger to motorists and pedestrians.

 

The school currently operates an informal one way system along Les Ruelles at drop off and collection times, however the Parish wish to formalise the restriction as there are safer alternative routes, and outside school times very few vehicles would be displaced to the alternative routes.   

   

Recommendation

 

The Minister is requested to approve the request.

To increase safety for motorists and pedestrians by making Les Ruelles one way in an easterly direction.

  

Action Required

 

Officers to instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.
