The transfer of capital funds from the rolling vote to HYR026, to meet the anticipated costs of the ongoing refurbishment at Clos de Roncier for 2008.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

VIREMENT OF CAPITAL BUDGETS

19-83 CLOS DE RONCIER.  

The Housing Department has committed to improving the standard of the properties contained within its property portfolio, as outlined in its Social Housing Property Plan 2007-2016 and subsequently ratified by the States Act dated 27th June 2006, whereby, States members adopted the Strategic Plan 2006 – 2011, in particular s.3.8.  

Clos de Roncier an estate of some 87 homes is currently undergoing the second phase of a 2 part refurbishment programme.  

The scope of works is to improve the thermal characteristics of each individual property by augmenting the loft insulation, replacing windows and doors and cladding each home with a proprietary external insulation system. New heating systems have also been installed and a host of infrastructure improvements are being undertaken. 

The project is well underway and using the programme a projection of costs for 2008 has been undertaken.  This has demonstrated that a virement of £800,000.00 will be required from the Department’s rolling vote to cover the anticipated expenditure during 2008.  To ensure proper accounting of all the costs associated with the project a project specific business unit HYR026 was created at the outset and the Minister is asked to consider a virement of £800,000.00 from the Department’s rolling vote to HYR026 to permit refurbishment work to continue on programme. 

Recommendation  

That the Minister approve the virement of £800,000.00 from the Department’s rolling vote to business unit HYR026.
