WWI POW Hut, Ville Canut, La Rue de la Corbiere, St. Brelade - List as Site of Special Interest.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

The purpose of this report is for the Minister to confirm the Listing of the PoW hut at Ville Canut, La Rue de la Corbiere, St Brelade.

Background

Ville Canut was added to the Register as a Building of Local Interest in 2001. In August 2006 advice was sought as to whether the former PoW hut on the site merited inclusion in the Registration of Ville Canut. Following further research a report was placed before the Minister recommending that the PoW hut, by virtue of its special architectural and historical interests, merited upgrading to a proposed Site of Special Interest. The Minister confirmed this recommendation on 9 November 2006 and subsequently, on 1 December 2006, confirmed the service of a Notice of Intention to List the structure as a Site of Special Interest.

Discussion

A notice of Intention to List the PoW hut was duly served on the owner of the site giving 28 days for representations against the Listing to be submitted. A letter of representation objecting to the Listing of the PoW hut was received on 15 December 2006 (attached). The owner expressed doubts about the authenticity of the hut as being part of the Blanches Banques PoW complex and suggested that expert advice be sought in order to clarify this matter. They also expressed concern about the timing of the information which brought the significance of the building to light; pointing out that there are potential conflicts with development proposals for Ville Canut. The matter of the condition of the building was also raised; the owner claiming that the building is in a ‘dilapidated state’.

Conclusions

Expert advice has been sought on the authenticity of the structure: a letter sent by email dated 11 April 2007 by Roger J C Thomas, Military Support Officer, English Heritage confirms its authenticity and is attached.

The Development Control issues raised by the owner are beyond the remit of this assessment, which should be strictly restricted to the assessment of the architectural and historical significance of the structure as it stands.

Whilst condition can affect the significance of a building or place, earlier assessments have taken this matter into consideration and concluded that the building, in its present condition, satisfies the published criteria for inclusion on the List by virtue of its special architectural and historical interest.

Recommendation

It is recommended that the Minister for Planning and Environment confirms the Listing of the PoW hut at Ville Canut, La Rue de la Corbiere, St Brelade as a Site of Special Interest by virtue of its special architectural and historical interest.

The decision gives statutory effect to that made on 1 December 2006 and affords appropriate protection to the special interests of the site in accord with States objectives.
