Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Subsidised Products Scheme Budget Transfer.
Decision(s): The Minister agreed to a budget transfer of £175,000 in 2008 from the Social Security Department to the Health & Social Services Department. The budget is included in the Social Security Annual Business Plan and cash limit for 2008.
Reason(s) for Decision: In late 2007 it was agreed by the Subsidised Product Scheme Working Party that the Subsidised Product Scheme (the ‘scheme’) should be more appropriately managed by Health & Social Services. The scheme is administered by Family Nursing & Home Care who are paid an annual grant from the Social Security Department to meet the provisions of the scheme. A Service Level Agreement exists between the two organisations. It was proposed that the budget, allocated from the Departments Social Fund and included in the Social Security Annual Business Plan and cash limit for 2008, be transferred to Health & Social Services from 1 January 2008. The amount to be transferred was £175,000 in perpetuity. It was noted that the £175,000 was adjusted in the cash limits for both Departments as part of the 2009 States of Jersey Annual Business Plan.

REPORT TO THE MINISTER FOR SOCIAL SECURITY

Transfer of Budget under the Subsidised Products Scheme to Health & Social Services

Purpose of the Report

To request approval for the transfer of the budget for the Subsidised Product Scheme, administered by Family Nursing & Home Care, to Health & Social Services from 1 January 2008. This transfer is to be made in perpetuity.

Background

The Social Security Department support the Subsidised Product Scheme through payment of an annual grant, to Family Nursing & Health Care who administer the scheme. A joint Working Party consisting of Social Security, Family Nursing and Health professionals have concluded that the scheme should be more appropriately managed by Health & Social Services.

At the current point in time the budget, which amounts to £175,000, remains within the Social Fund of the Department of Social Security and therefore within its cash limit for 2008. It therefore requires transferring to Health & Social Services from January 2008.

Recommendation

The Minister is recommended to approve the transfer of £175,000 to Health & Social Services from 1 January 2008. The transfer to be in perpetuity.
