Revised Driving Licence Application Form

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TO APPROVE THE REVISED DRIVING LICENCE APPLICATION FORM D1

 

 

PURPOSE OF THE REPORT

 

To request the approval of the Minister for a question to be added to the Driving Licence application form (D1), in respect of Article 4 (2) (a) of the Road Traffic (Jersey) Law 1956 and to make minor changes, mostly cosmetic, to the layout and wording of other sections on the application form and the notes.

 

 

BACKGROUND

 

The Comité des Connétables has agreed to the suggestion of the Love Hearts Appeal that a question be added to the driving licence application form.

 

Love Hearts Appeal is a local charity started by the MacLachlan family and one of its aims is to increase the number of Jersey residents who have registered as organ donors.

 

The proposal was supported by the former Minister for Transport and Technical Services (letter dated 24 January 2014 ref KL/ASM/JG 64/1 DRIV/LI/8F (199).

 

In adding the Organ Donation question, the opportunity has also been taken to make minor changes, mostly cosmetic, to the layout and wording of other sections on the application form and the notes which are summarised as follows:

 

  1. Jersey driver number – form and notes amended as location of driver number on the Jersey driving licence changed on the introduction of laser printed licences in August 2014.
  2. Eyesight – remove duplicate instruction on form
  3. Licence application – questions reordered under sub-headings relating to full, provisional and duplicate licence so clearer for applicants
  4. Disqualification – reworded to refer also to endorsements
  5. Health – additional space to describe any special controls fitted to a vehicle; otherwise only cosmetic changes to wording/layout
  6. Identity – cosmetic changes to form and notes so references are consistent
  7. Organ donation – addition of question to form and of information in Notes
  8. Vehicle categories in Notes – moped (category P) moved to top of list in response to feedback received from member of public
  9. Addition of parish hall contact details in Notes (in response to feedback from member of public)

 

 

A proof of the new form will be requested but as application form stocks are low it will be necessary to place an order as soon as possible.

 

 

RECOMMENDATION

 

The Minister is recommended to approve the revised driving licence application form D1.
