Road Traffic (Grouville) (Amendment No 5) (Jersey) Order 2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Road Traffic (Grouville) (Jersey) Order 2002

Decision(s): The Minister made the Road Traffic (Grouville) (Amendment No 5) (Jersey) Order 2009 to become effective seven days after it is made.

Reason(s) for Decision: To introduce a 20 minute parking restriction on a section of the west side of La Grande Route des Sablons to allow improved vehicle movement to and from the parking spaces outside “Verona Stores”. To update the description in Schedule 1 of the Order (One-Way Traffic Routes) with regard to Beach Road, from “Grouville Service Station” to “The Hamlet”.

Resource Implications: Transport and Technical Services Department’s time.

Action required: To notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Publications Editor, States Greffe, for notification to the States.

TRANSPORT AND TECHNICAL SERVICES  

ROAD TRAFFIC (GROUVILLE) (JERSEY) ORDER 2002 – AMENDMENT  
 

Purpose of the Report  

To amend the Road Traffic (Grouville) (Jersey) Order 2002. 
 

Background  

On 07 December 2009 the Minister for Transport and Technical Services approved a request, subject to public consultation, to amend the above Order to make a section of the west side of La Rue de la Ville es Renards, outside  “Verona Stores”, subject to a 20 minute parking restriction.  

The Parish have since confirmed that the proposed restricted area is in fact on La Grande Route de Sablons, and not La Rue de la Ville es Renards. 
 

Discussion  

Following a period of consultation in the form of a notice placed outside Verona Stores informing the public of the proposed change, four comments were received. The common message of those commenting was that the change was unnecessary. 

However both the Department and the Parish consider that the time limit will provide support for a valuable local facility, which is consistent with the Transport and Technical Services sustainable transport policy in providing local facilities within walking distance,   

While drafting the necessary Order Amendment the Law Draftsman has taken the opportunity to update Article 1 of the Order (One-Way Traffic Routes) with regard to Beach Road, by substituting the words “Grouville Service Station”, which no longer exists, with “The Hamlet”.  

Recommendation

 

The Minister is requested to approve the attached Road Traffic (Grouville) (Amendment No.5) (Jersey) Order 2010 with regard to the above items, to be included in the Road Traffic (Grouville) (Jersey) Order 2002 and to become effective seven days after the Order is made.
