Waste management licence and discharge consent applications for La Collette energy from waste facility

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the submission to the Minister for Planning and Environment of applications for a Waste Management Licence in accordance with Article 26 of the Waste Management (Jersey) Law 2005, and the submission to the Minister for Planning and Environment for a Discharge Consent relating to the La Collette Energy from Waste facility in accordance with Article 20 of the Water Pollution (Jersey) Law 2000.

TRANSPORT AND TECHNICAL SERVICES  

LA COLLETTE ENERGY FROM WASTE FACILITY

WASTE MANAGEMENT LICENCE AND DISCHARGE CONSENT APPLICATION  
 

Purpose of the Report  

To give approval to submit applications for Waste Management Licence and Discharge Consent Applications to enable operation of the La Collette Energy from Waste Application. 
 

Background  

The La Collette Energy from Waste Facility will enter its commissioning stage from the summer of 2010. From October 2010, waste may be required to be received and cooling water and surface water discharged from the site.  

Under the Waste Management (Jersey) Law 2005, operators of waste facilities are required to have a Waste Management Licence to receive waste. 

Under the Water Pollution (Jersey) Law 2000, those wishing to discharge to controlled waters must have a Discharge Consent. 

Both applications will be to the Minister for Planning and Environment who is the Regulator of the above laws. 

A Waste Management Licence and Discharge Consent Application have been prepared for submission and Ministerial approval is required to enable submission. 
 

Discussion  

Both the Waste Management Licence and Discharge Consent Application processes require periods of public consultation before the Minister for Planning and Environment can determine them. 

The Waste Management Licence has been prepared in accordance with UK Guidelines for Environmental Permits for such facilities by Fichtner Consulting Engineers who have submitted many such applications in the UK. 

The Waste Management Licence submission includes:

·     Drawings

·     Site Condition Report

·     Noise Assessment

·     Risk Assessment

·     Air Quality Assessment

·     Technology Assessment

 

The Discharge Consent application has been prepared following full consultation with the Jersey Electricity Company, to whom the cooling water system which will be employed belongs. The application has been prepared by Fichtner Consulting Engineers. 

Both applications have been subject to full consultation with the relevant Officers representing the Regulator. 
 

Recommendation 

That the Minister agree to submit the Waste Management Licence and Discharge Consent Applications
