St. Thomas' Residents Parking Zone.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ORDER 1996 – AMENDMENT TO INCLUDE ST THOMAS’ RESIDENTS PARKING ZONE 

Purpose of the Report 

To seek the Minister’s approval for a request from the Parish of St Helier to introduce a new Residents Parking Zone and request the Law Draftsman to draft the necessary legislation. 

Background 

A request has been received from the Parish of St Helier seeking approval for the introduction of a new Residents Parking Zone (RPZ) to be called St Thomas’ Residents Parking Zone. A number of discussions have taken place between Officers from Transport and Technical Services and representatives of the Parish of St Helier regarding this scheme and both the Parish and TTS are now in agreement with the proposal. A map showing the proposed new zone is attached as Appendix 1.  

This will be the third RPZ within St Helier - the others being Stopford Road, Cheapside and Richmond Road. 

Discussion 

Parish officers have drawn up the proposed zoning and consulted widely with residents and businesses in the area. The scheme reduces the number of available paycard spaces in predominantly residential areas to allow for more RPZ permits to be issued but it does provide an adequate number of paycard parking areas for people visiting the area. Although there will be a reduction in TTS income from paycards as a result, there will also be a more than compensating reduction in the cost of policing the areas. 

TTS supports the introduction of this RPZ with the Parish of St Helier taking responsibility for the enforcement and administration of the zone, as is currently the arrangement with the existing RPZs. 
 

Recommendation 

The Minister is recommended to:  

  1. approve the request from the Parish of St Helier to implement a new Residents Parking Zone (to be called St Thomas’ Residents Parking Zone); and
  2. request the Law Draftsman to prepare an amendment to the Road Traffic (St Helier) (Jersey) Order 1996 to incorporate this.
