Jersey Advisory and Conciliation Service - New Board Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Background

The Jersey Advisory and Conciliation (Jersey) Law 2003 provides that the Board of the Jersey Advisory and Conciliation Service shall consist of not more than seven members who must not be members of the States.

Members of the Board must be selected and appointed by the Board, subject to the approval of the Minister, and the Minister must inform the States of any such appointment.

Membership

Mr Kevin Keen and Mr David Warr both resigned from the Board effective from 29 September 2011.

Mr John Moulin retires from the Board effective from 31 December 2011 at the end of his current term.

Mrs Lorna Pestana will resign from the Board effective from 29 February 2012.

The following members will remain on the Board:

-          Mr Thomas Slattery, Chairman

-          Mr Edmund Daubeney, Deputy Chairman

-          Miss Julie Crabtree.

Recruitment

The four positions on the Board were advertised in the Jersey Evening Post and a recruitment process was undertaken in accordance with best practice. Interviews were conducted by Mr Slattery and Mr Daubeney and the Board has selected four new members.

The Social Security Minister approves the appointment of the following new members for the terms specified:

Mrs Alison Mellor - Senior Staff Representative of Unite, Lloyds TSB, for a maximum term of four years, effective from 1 October 2011.

Mrs Sarah Beirne - Head of Human Resources at PricewaterhouseCooper, for a maximum term of four years, effective from 1 October 2011.

Mr Craig Channing - Chairman of the Fire Service Association, for a maximum term of four years, effective from 1 January 2012.

Advocate Zoe Blomfield - Managing Partner of Viberts, for a maximum term of four years, effective from 1 March 2012.

It is considered that the new members will bring valuable knowledge and experience to the Board.

I would like to thank the retiring members for their contribution to the Board and would also like to thank the Chairman, Mr Slattery, and the continuing Board members for their continued commitment to JACS.
