Transfer of Technical Support Officer Budget to Chief Minister's Department

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister agreed the funding transfer of £42,000 to the Chief Ministers Department, for Information Services, with effect from 01 January 2009.

Reason(s) for Decision:

To provide HMP La Moye with technical support, advice and guidance encompassing all their current and future IT systems.

Resource Implications:

FTE has been provided by HM Prison in 2008 from within their authorised FTE’s.

Action Required:

The Finance Director to request the Treasurer of the States to action this as a non-contentious transfer between departments in accordance with Financial Direction 3.6 (Variations to Heads of Expenditure).

Transfer of Technical Support Officer Budget from the Homes Affairs Department to the Chief Ministers Department

 

1.                INTRODUCTION

The purpose of this report is to:- 

·               outline the background and circumstances of the transfer of the budget of a Technical Support Officer post within HM Prison to the Chief Minister’s  Department;

·               seek the Minister’s approval of the funding transfer with effect from 01 January 2009.

  

2.                BACKGROUND

·               During the development of IT systems within HMP La Moye the provision of technical support was provided by the temporary part-time employment of an IT Consultant 

·               To achieve a more dedicated IT provision encompassing the support, advice, guidance and greater access to both on-site, out of hours and remote technical support required by the Prison discussions were held in 2008 with the Senior IT Officer and Senior Manager from the Business Support Group, Chief Ministers Department. An agreement was reached that they would, with the provision from HMP La Moye of an authorised fte and the appropriate budget, provide this service.

  

3.       RECOMMENDATION

It is recommended that the Minister agrees to the transfer of the funding from 01 January 2009 in the amount of £42,000 to the Chief Ministers Department.
