MANUAL WORKERS’ JOINT COUNCIL – EMPLOYER’S SIDE MEMBERSHIP
Issue
The States Employment Board (SEB) is advised that in accordance with the provisions of the Manual Workers’ Joint Council Constitution and Schedule of Wages and Working Conditions (the “Handbook”) the Manual Workers’ Joint Council (MWJC) shall be constituted of 10 members of whom 5 shall represent the Employer. The 5 Employers’ representatives shall be appointed on an annual basis and are apportioned as follows:-

The Constables of Jersey (The Constables have confirmed that they would normally expect their representative to be the Constable of St Helier). | One Representative |
Background and Discussion
The current Employer’s Side membership of the MWJC consists of:
- Deputy Ian Gorst (Employer’s Side Chairman)
- Senator James Leslie Perchard
- Mr M Pollard – Chief Executive, HSS
- Mr J Richardson – Chief Executive Officer, TTS
However, following their respective elections to Minister of the Social Security Department and Minister of the Health and Social Services Department, Deputy Gorst and Senator Perchard have signalled their intention to resign their membership of the MWJC. Mr Pollard and Mr Richardson have agreed to remain Employer’s Side members for 2009. Thus, the SEB is required to:
- Determine if it is content for Mr Pollard and Mr Richardson to continue as its representatives; and,
- Determine which States Members it should invite as its representatives.
It is understood that both Senator Paul Routier (Assistant Minister, Chief Minister’s Department) and Deputy Andrew Green (Assistant Minister, Education, Sport and Culture) have expressed an interest in joining the Employers’ Side.
Recommendation
The States Employment Board is recommended to:-
- Appoint the following people to be the Employer’s Side of the MWJC –
- Senator Paul Routier
- Deputy Andrew Green
- Mr M Pollard – Chief Officer, HSS
- Mr J Richardson – Chief Officer, TTS
- To approve the attached Report and Proposition to the States. The Chief Minister should then be invited to take the matter to the States for approval.

The States are asked to decide whether they are of the opinion –
In accordance with their Act dated 9th November 1961, as amended, concerning the membership of the Manual Workers’ Joint Council, to approve the nomination of the four representatives of the States to serve as members of the Employers’ Side of the Council for 2009, as follows –
Senator Paul Francis Routier
Deputy Andrew Kenneth Francis Green M.B.E.
Mr John Michael Pollard, Chief Executive, Health and Social Services
Mr John Richardson, Chief Executive Officer, Transport and Technical Services

Explanatory Note
The Employers’ Side membership comprises four representatives of the States and one representative of the Connetables.
The Employers’ Side represents the Executive in negotiations with the Unite (Transport and General Workers’ section) Union on Manual Workers’ pay and conditions of service. The nominations for the States’ representatives have been based on the fact that they are Assistant Ministers or Chief Officers of departments employing significant numbers of Manual Workers.
