Economic Development Department: Increase in staff numbers

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Request to increase the number of Full Time Equivalent (FTEs) in Economic Development (EDD) by 4 to 60.3 FTEs.

Decision(s):

The Minister decided to request the increase in staffing levels to 60.3 FTEs.

Reason(s) for Decision:

The Medium Term Financial Plan (MTFP) does not include increase in staffing already approved by decisions MD-E-2013-0089.  In addition, two unfunded FTEs were not included in MTFP. It was originally understood that unfunded FTEs do not have to be included in MTFP and this decision seeks to rectify this error. Following MD-E-2013-0089 that gave approval to establish the Jersey Aircraft Registry (JAR), MD-E-2013-0103 instructed the Law Draftsman to commence drawing up the necessary legislative package for the establishment and delivery of the JAR.  The draft Aircraft Registration (Jersey) Law 201- (AR(J)L201-) will shortly be lodged, for debate in the States.  In order to establish and deliver the JAR, it will be necessary to recruit a Registrar to fulfil the functions and responsibilities of the Registrar of Aircraft as detailed in the AR(J)Law 2014.  As the JAR develops a Deputy Registrar will be recruited.

Resource Implications:

This decision will result in an increase in staffing levels in the Economic Development Department to 60.3.

Action required:

Acting Finance Director to inform HR and the Strategic Policy Manager that the decision has been approved.
