Establishment of a Police Authority in Jersey

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Establishment of a Police Authority in Jersey.

 

Decision(s):  The Minister approved the appended draft report and proposition concerning the establishment of a Police Authority in Jersey and associated matters, and requested that it be lodged ‘au Greffe’  forthwith and with a view to securing the earliest possible date for debate.

 

Reason(s) for Decision:  The States first approved the establishment of a Police Authority on the 19th May 1998.  On the 23rd March 2010, following the proposition of Senator Breckon (P.23/2010 – Independent Jersey Police Authority Establishment) the States approved the following: “to request the Minister for Home Affairs to present to the States for approval no later than December 2010 detailed proposals for the establishment of an Independent Jersey Police Authority to oversee the work of the States of Jersey Police.”  Following the production of a report by the Chief Officer, Home Affairs, dated March 2010, the Minister for Home Affairs set up a Consultative Group of politicians to advise him on this Proposition.  Subsequently, the Minister for Home Affairs consulted with the Chief Officer of Police, designate, prior to the production of the final form of the Proposition.

 

Resource Implications:  Provision has been made in the Home Affairs Department’s growth bids for 2012 in the sum of £100,000.  It has not yet been decided whether members of the Authority should receive an honorarium or whether the Authority will require an executive officer or secretary.  Any changes to the draft Law will require law drafting time

 

Action required:

The Executive Officer, Home Affairs, to request the Greffier of the States to arrange for the attached Proposition to be lodged ‘au Greffe’ for consideration by the States early in 2011.
