Motor Mall, Grande Route de St. Jean, St. Helier - enforcement notice.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s) 

The Minister directed that an Enforcement Notice be served on the owners of Motor Mall, La Grande Route de St. Jean, St. Helier in accordance with the provisions of Article 40 (2) (a) (b) and (c) Planning and Building (Jersey) Law 2002 for information to be supplied and works satisfactorily completed.

 
Reason(s) for decision:   

There have been breaches of development controls in that prescribed work has been undertaken but not completed, or, not proved to comply with the Building Bye-Laws.

In June 2007 Miss S. Read visited Motor Mall, La Grande Route De St. Jean, St. Helier to carry out a site inspection to inspect work undertaken under a Building Permit. She found that these works had been undertaken not as per the approved plans. A retrospective application in respect of these works was required and subsequently received by the Department. 

On 29th October 2007 Miss Read, having visited the site in the interim, returned and found that numerous items had not been addressed and that a drainage system had been covered without a required inspection. The outstanding items are as follows:- 
 

  1. Fire alarm certificate to be provided to the altered fire alarm

 

  1. Emergency lighting certificate to be provided for the altered emergency lighting system

 

  1. Confirmation that all elements of structure achieve the correct fire resistance.

 

  1. Calculations to be provided to justify the altered unprotected areas.

 

  1. The foul drainage to the exterior of the building has been covered up without inspection thereby necessitating a full camera survey and the results of which are to be submitted to the Department. Also that two sections of the drainage run are to be opened up for inspection.

 

  1. Confirmation that all new glass in critical locations is safety glazing

 

  1. The u values for the new façade to be confirmed

 

  1. Percentage of exposed walls to demonstrate compliance with Approved Document L2

 
 
 
 
 
 
 
 
 

These outstanding matters are breaches of development control in that without supplying this information the owners cannot demonstrate that the development complies with the requirements of the relevant Building Bye-Laws. 
 

The Building Control Department has attempted to secure the owners compliance but without success. It is therefore requested that an Enforcement Notice be served in order to remedy this situation by requiring the owners to supply the required information and open up completed works for inspection where necessary.
