Economic Development (2012 Fees) (Jersey) Order 2011

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister made the Economic Development (2012 Fees) (Jersey) Order 2011. (“the Order”)  

Reason(s) for Decision:

The Economic Development (2012 Fees) (Jersey) Order 2011 permits the increase of fees under the following laws, Places of Refreshment (Jersey) Law 1967, Tourism (Jersey) Law 1948, Weights and Measures (Jersey) Law 1967 and Shipping (Jersey) Law 2002.  

Resource Implications:

The only financial implication to this order will be an increase in fees currently charged. This increase will be approximately 2.5% from those last increased. There are no negative financial or manpower costs for the States.  

Action required:

Notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Publications Editor, States Greffe, for notification to the States.

Background

 

The Order amends the following;

1 Places of Refreshment (Registration) (Fees) (Jersey) Order 2008 amended

In Article 1 of the Places of Refreshment (Registration) (Fees) (Jersey) Order 2008, for the figure “£80” there shall be substituted the figure “£82”.

 

The increase for this fee was agreed by ministerial decision, MD-E-2011-0143, on 19 September 2011.

2 Tourism (General Provisions) (Jersey) Order 1990 amended

For Schedule 1 to the Tourism (General Provisions) (Jersey) Order 1990 there shall be substituted the following Schedule   FEES FOR REGISTRATION OR RENEWAL OF REGISTRATION

The increase for these fees were agreed by ministerial decision, MD-E-2011-0142, on 19 September 2011.

 

3 Weights and Measures (Testing Fees) (Jersey) Order 2003 amended

The above Testing fees are paid to the Department in respect of the testing weighing and measuring equipment with a view to such equipment being passed as fit for trade use.

The increase for these fees where agreed by ministerial decision, MD-E-2011-0141, on 15 September 2011.

4 Shipping (Fees) (No. 2) (Jersey) Order 2008 amended

(1) In Article 1 of the Shipping (Fees) (No. 2) (Jersey) Order 2008, for the word “act” there shall be substituted the words “act or application”.

(2) For the Schedule to the Shipping (Fees) (No. 2) (Jersey) Order 2008 there shall be substituted the following Schedule    FEES UNDER SHIPPING (JERSEY) LAW 2002

Recommendation
