Statistics User Group - Appointment of Member.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

REPORT TO CHIEF MINISTER

Statistics User Group: Appointment of member

1. The Statistics User Group was established by the States in 1999 as an independent body to review and comment upon official statistics in Jersey, including their compilation, dissemination and relevance, and to make recommendations to the Chief Minister where appropriate.

2. The User Group currently has a Chairperson and ten members, including Mr. David Wild who was appointed as a member in February 2006 after having been nominated by Jersey Finance Limited. Mr. Wild will shortly be leaving his employment with Jersey Finance, and it has been proposed that he should be replaced as a member of the User Group by Ms. Peggy Gielen, who works for Jersey Finance Limited as Technical Manager.

3. It will be recalled that at the end of 2005 it was necessary to advertise for a chairman and five members to fill some vacancies which had arisen in the User Group.

Nominations for members were received from ten different organisations, and these nominations included one from Jersey Finance Limited for two persons to serve on the User Group, namely David Wild and Peggy Gielen. The view was taken at that time that there should be a broad range of representation on the User Group, and nominations from the maximum possible number of organisations (i.e. five) were therefore accepted. In the case of Jersey Finance, it was decided to appoint the more senior of the two nominees, i.e. David Wild.

4. Given that an advertisement for members was placed relatively recently, and that a nomination was received from Jersey Finance Ltd in respect of Ms. Gielen, it is recommended that she should be appointed to replace Mr. Wild as a member of the User Group. The Appointments Commission has been consulted in this matter and has indicated that it does not raise any objection to this proposal.

6. Subject to your approval, Ms. Gielen’s appointment would take immediate effect and would run for a period of three years.
