Planning and Environment (2011 Fees) (Jersey) Order 2011

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Introduce a new method of charging and an increase in charges for Planning and Building Applications for 2011 'as set out in the report dated 28/1/2011 attached'.

Decision(s): The Minister made the Planning and Environment (2011 Fees) (Jersey) Order, having determined that the Order should come into force on the 2 May 2011.

Reason(s) for Decision:

To increase fee income from applications in accordance with:

  1. a 2.5% cost of living uplift as agreed by the Treasury for all applications within the Order save for those for the erection of flats or dwellings or the extension of flats or dwellings (residential development)
  2. a new method of charging for residential development, in respect of Planning Applications, where the charge will be based on the area of the building rather than per unit.

Resource Implications:

There are no resource implications.

Action required:

To notify the States Greffe that the Order has been signed, and to forward the signed and sealed Order to the States Greffe immediately.

That the Greffier of the States be requested to lay the said Order before the States at the earliest opportunity.

Explanatory Note

This Order increases fees under the following enactments 

Animal Welfare (Licence Fee) (Jersey) Order 2008

Dangerous Wild Animals (Jersey) Law 1999

Artificial Insemination of Domestic Animals (Jersey) Law 1952

High Hedges (Application Fee) (Jersey) Order 2008

Waste Management (Fees) (Jersey) Order 2008

Planning and Building (Fees) (Jersey) Order 2008.

 

The increases are the first since 1st January 2010. The increases generally are around 2.5%.

However, the basis of calculation of the Schedule 1 fees for planning permission, and the Schedule 2 fees for building permission, for the creation of new flats and new dwelling houses has been recast and so those fees are not strictly comparable with the current fees.

Furthermore, certain planning and building fees will not change, notably in the area of certain modifications of existing structures.

2 Dangerous Wild Animals (Jersey) Law 1999 amended

In Schedule 3 to the Dangerous Wild Animals (Jersey) Law 1999 for the amount “£256.25” there shall be substituted the amount “£262.65”.

3 Artificial Insemination of Domestic Animals (Bovine Semen) (Jersey) Order 2008 amended

For Article 48 of the Artificial Insemination of Domestic Animals (Bovine Semen) (Jersey) Order 2008 there shall be substituted the following Article 

“48 Fees

The following fees are prescribed for the purposes of Article 2(3) of the Artificial Insemination of Domestic Animals (Jersey) Law 1952 

(a) for the grant of a licence of premises as an EC quarantine centre under Article 3(1), £165.75, plus a fee of £81.80 payable on the re-inspection of the premises after a year, and every year thereafter;

(b) for the grant of a licence of premises as an EC collection centre under Article 3(2), £206.65, plus a fee of £81.80 payable on the re-inspection of the premises after a year, and every year thereafter;

(c) for the grant of a licence of premises as an EC quarantine centre and as an EC collection centre under Article 3(1) and (2), £288.45, plus a fee of £81.80 payable on the re-inspection of the premises after a year, and every year thereafter;

(d) for the grant of a licence of premises as an EC storage centre under Article 3(3), £124.85, plus a fee of £81.80 payable on the re-inspection of the premises after a year, and every year thereafter;
