Energy Partnership: Terms of Reference: Update

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Council of Ministers in their meeting of 24 May agreed that the terms of reference of the Energy Partnership should be extended to include the response to the climate emergency. The Energy Forum agreed this approach in their meeting of 13 June 2019.

Pathway 2050: Energy Partnership

Amendment to the Terms of Reference for the Energy Forum in light of P.27, declaration of a climate emergency and the aim to be Carbon Neutral by 2030

 

Background

The Energy Partnership was set up under Pathway 2050 to ‘monitor, review and work towards a low carbon Jersey in line with actions outlined in Pathway 2050.’  The Partnership comprises two parts – the Ministerial Energy Executive and the multi-stakeholder Energy Forum. The proposed amendment to terms of reference only applies to the Energy Forum.

 

 

The draft terms of reference of the Energy Executive and Forum were confirmed at the first meeting of the Executive on August 28th 2014[1].

 

The Declaration of a Climate Emergency P.27/2019

The terms of reference for the Energy Forum needs to be amended to reflect the states assembly decision to declare a climate emergency (P27/2019 2nd May 2019).  The declaration of the climate emergency is reflected in the proposed Government Plan.

 

In agreeing P.27, as amended, The States have agreed that:

“there exists a climate emergency likely to have profound effects in Jersey, and that in order to deal with this situation:-

(a)    Jersey should aim to be carbon-neutral by 2030, and the Council of Ministers is accordingly requested to draw up a plan to achieve this, for presentation to the States by the end of 2019;

(b)    The Minister for the Environment is requested to carry out, as part of the process for drawing up the forthcoming Government Plan for 2020, an examination and assessment of more ambitious policies to accelerate carbon reduction. This will include an assessment of the use of fiscal levers to change behaviour and raise awareness

(c)     The Chief Minister is requested to ensure that consideration of action to tackle climate change in Jersey is included as a standing item on the agenda of the Council of Ministers.”

 

 

The extended role of the Energy Forum

 

In order to discharge the requirements of P.27/2019 the Council of Ministers has agreed that it is vital to bring stakeholders on board. The Council agreed that the Energy Partnership would be reframed to cover the broader carbon neutral remit and that they will extend their existing terms of reference to provide governance and political oversight of the carbon neutral journey through the Ministerial Executive and stakeholder representation through the Energy Forum.  It will monitor, review and work towards achieving Jersey’s aim to be carbon neutral by 2030 and the Energy Plan: Pathway 2050.

 

The carbon neutral strategy will be presented by the end of 2019 in accordance with part (a) of the proposition above. 

The terms of reference of the Energy Forum (as agreed on 28th August 2014) will be amended as follows:

1.8 In light of P.27/2019 the Energy Forum will:

Support the development of the carbon neutral strategy by for example:

- Considering and advising on the definition and scope of carbon neutrality in the Jersey context

- Consider the benefits and risks of the proposed carbon neutral strategy
