Driving Licences: Fee Increase: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO THE MOTOR VEHICLES (DRIVING LICENCES) (JERSEY)

 

ORDER 2003

 

 

Purpose of the Report

 

To request that the Minister for Infrastructure supports the proposal of the Comité des Connétables to increase the fees set for a Jersey driving licence.

 

In addition, to request that the Minister approves for drafting instructions to be issued to the Law Draftsman in order to prepare a draft Order amending the Motor Vehicles (Driving Licences) (Jersey) Order 2003.

 

 

Background

 

The Comité des Connétables has reviewed the fees set for a Jersey driving licence and have proposed an increase. The Connétables have advised that they prefer to avoid small increases in fees each year and instead seek an increase every few years. They have requested that the Minister amends the fees set out in Schedule 3 of the Motor Vehicles (Driving Licences) (Jersey) Order 2003.

 

 

Discussion

 

The ‘credit card’ style driving licences, valid for 10 years, were introduced in April 2007 and the fee for a full licence was set at £40 and £15 for a provisional licence.

 

From June 2007 to December 2016 the Retail Prices Index increased by 23.9% and the proposed fees fall broadly in line with the cost of living increases since 2007.

Article 7(3)(a) Motor Vehicles (Driving Licences) (Jersey) Order 2003

 

Licence granted which, by virtue of Article 4(5) or (6) of the Law, remains in force for less than 10 years.

Any reference to an alternative charge for a licence issued before 4 April 2007 can also be removed from the Order.

 

The Comité des Connétables have requested that the Minister amends the fees set out in the Motor Vehicles (Driving Licences) (Jersey) Order 2003 to come into effect from 1 May 2017, the start of the financial year in each parish.
