Register of Buildings and Sites of Architectural, Historical and Archaeological Importance: Appeal against registration – 10, 11, 12, 13, 19, 21, 22, 23, 24, 26, 27 & 29-31 Commercial Buildings, St Helier.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for Planning and Environment determined that:

1. The following buildings shall be retained on the Register as proposed Sites of Special Interest: The merchant’s house/offices at 11 & 12 Commercial Buildings;

2. The following buildings shall be downgraded to Buildings of Local Interest: The merchant’s houses/offices at 10, 13, 19, 21, 22, 23, 24, 26 & 27 Commercial Buildings and the Warehouses at 30 & 31 Commercial Buildings.

3. The following buildings shall be removed from the Register: warehouses to the rear of 10, 11, 12, 13, 19, 22, 23, 24, 26, 27 & 29 Commercial Buildings.

4. The views of the Ministerial Registration and Listing Advisory Group should be sought in relation to Warehouses ‘A’ (west) and ‘B’ (east) to the rear of 21 Commercial Buildings.

Reason(s) for decision

In accordance with the strategic objective ‘to protect the best of the Island’s architectural heritage’ of the Island Plan 2002, and Policy HB1 of the Interim Policies for the Conservation of Historic Buildings:

The merchant’s house/offices at 11 & 12 Commercial Buildings satisfy the criteria for Registration as proposed Sites of Special Interest.

The merchant’s houses/offices at 10, 13, 19, 21, 22, 23, 24, 26 & 27 Commercial Buildings and the Warehouses at 30 & 31 Commercial Buildings satisfy the criteria for Registration as Buildings of Local Interest.

The warehouses to the rear of 10, 11, 12, 13, 19, 22, 23, 24, 26, 27 & 29 Commercial Buildings do not satisfy the criteria for Registration.

The Minister considered that further advice should be sought in respect of an assessment of Warehouses ‘A’ (west) and ‘B’ (east) to the rear of 21 Commercial Buildings.

Action required:

  Notify the appellant of the decision

  Amend the Historic Buildings Register accordingly

  Notify Development Control - Urban Section of the decision

· Prepare relevant papers associated with the proposed designation of nos. 11 and 12, Commercial Buildings as Sites of Special Interest, to be the subject of a further report to the Minister

· Refer the assessment of Warehouses ‘A’ (west) and ‘B’ (east) to the rear of 21 Commercial Buildings to the Ministerial Registration and Listing Advisory Group.
