Jersey Teachers' Superannuation Fund: Board of Management: Nomination of Employers' Representative

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for the Decision:

Article 3 of the Teachers’ Superannuation Fund (Administration) (Jersey) Order 2007 gives the Minister for Education the power to recommend two representatives to the Board of Management to act for the Employers’ side.

JERSEY TEACHERS’ SUPERANNUATION FUND

 

BOARD OF MANAGEMENT - NOMINEE

 

 

Purpose of the Report

 

The Education Minister is asked to approve a nomination to the Board of Management of the Jersey Teachers’ Superannuation Fund.

 

Background

 

Paragraph 3 of the Teachers’ Superannuation (Administration) (Jersey) Order 2007 requires the following – that membership of the Board of Management consists of twelve representatives in total, 2 to be recommended by the Chief Minister, 2 by the Minister for Treasury and Resources, and 2 by the Minister for Education whilst the remaining six are nominated by the relevant teachers’ representative bodies.

 

The Chairman of the Board, Mr Gordon Pollock, was appointed by the Chief Minister in 2014, and holds office for the period agreed to by a majority of the member representatives and a majority of the employer representatives.

 

Subject to the support of the Education Minister, the nomination will be forwarded to the States Employment Board for approval, and the Chief Minister will be asked to sign a Ministerial Decision to implement the decision.

 

Comments

 

Following the resignation of Mr Tom McKeon, a previous nominee of the Education Minister, an open recruitment process was undertaken – following Appointment Committee Guidelines - and Mr John Everett is recommended as the replacement member.

      

Recommendation

It is recommended the Education Minister should nominate the following person to serve as an employer representative of the Jersey Teachers’ Superannuation Fund Board of Management.

 

EMPLOYER NOMINEE – MR JOHN EVERETT

 

Mr John Everett has held the position of Deputy Director General at the Jersey Financial Services Commission since November 2015 (before that he was one of the JFSC’s Supervision Directors).

 

Prior to Jersey, Mr Everett worked at the Financial Services Authority/Financial Conduct Authority in the UK where he focused on investment management and conduct issues, including representing the United Kingdom at European Union and international committees, and negotiating EU directives and regulations for the UK together with HM Treasury.

 

Mr Everett is an experienced public policy professional with leadership experience of both small and large terms. In the UK he was a Director of the Electoral Reform Society for a number of years and has recently been appointed as an ‘independent’ member of the Jersey Employment Forum.
