The transfer of capital funds from the rolling vote to HYR038, to cover the costs for the Initial Project Assessment for 1 - 39 Hampshire Gardens.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

REPORT TO THE HOUSING MINISTER  

VIREMENT OF CAPITAL BUDGETS

Nos 1-39 HAMPSHIRE GARDENS.  

The Housing Department has committed to improving the standard of the properties contained within its property portfolio, as outlined in its Social Housing Property Plan 2007-2016 and subsequently ratified by the States Act dated 27th June 2006, whereby, States members adopted the Strategic Plan 2006 – 2011, in particular s.3.8.  

As part of this programme of maintenance the Housing Department intends to identify those estates which are in such a condition as to warrant remedial refurbishment.  

An Initial Project Assessment (IPA) was carried out at nos 1-4 Hampshire Gardens and concentrated on the practicalities of refurbishing those 4 bed-sitters into 2 no. 1 bed flats adopting the life-long homes standards. The IPA confirmed the proposal as achievable and has now been expanded to consider the possibilities of refurbishing the all of the 38 no. bed-sitters and 1 no. 2 Bedroom flat into 1 bedroom life-long homes, to meet the increasing demand for homes for those over 55.  The Department’s own waiting lists for such homes stands at 366 individuals. 

Given that, Department intends to expand the IPA which will be carried out in accordance with Financial Direction 5.6 (para 5.6.4 – 5.6.11).  The cost of this is not estimated to exceed £ 3,000.00.  To ensure proper accounting of all the costs associated with the project a new project specific business unit HYR038 has been created and the Minister is asked to consider a virement of £3,000.00 from the Department’s rolling vote to HYR038. 

Recommendation  

That the Minister approve the virement of £ 3,000.00 from the Department’s rolling vote to business unit HYR038 to cover the cost of the IPA.
