Cycle Helmets: Compulsory use by young cyclists: Law Drafting Instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Law Drafting Instructions for Compulsory Wearing Of Cycle Helmets By Young Cyclists.

 

Decision(s):  The Minister agreed that the Consumer Safety (Protective Helmets) Order 2006 should be amended to prohibit the supply of cycle helmets other than those certified as compliant with British Standard (BS) EN 1078 : 1997, amended 2005.

Reason(s) for Decision:

The States, on 10th March 2010, adopted part of P.4/2010 and thereby requested the Minister for Transport and Technical Services to bring forward legislation to ensure that cyclists were required to wear a suitable safety helmet whilst cycling in the case of persons aged under the age of 18 years.

 

The Minister for Transport and Technical Services has approved law drafting instructions to amend the Road Traffic (Jersey) Law 1956 to require children under 14 years old to wear a cycle helmet when riding a cycle on public road, cycle track or in a public park.

 

A consequent amendment to the Consumer Protection (Protective Helmets) (Jersey) Order 2006 is required to ensure that cycle helmets sold in Jersey would comply with a reputable standard.  The law drafting instructions also include instructions to secure an amendment to the above Order.  As the Order is administered by the Minister for Economic Development, his endorsement is required.

Resource Implications:  None for Economic Development

Action required:  Director of Trading Standards to advise the Head of Driver and Vehicle Standards that the instructions can be forwarded to the Law Draftsman so that the necessary changes to legislation can be drafted.
