A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

1. To enter into a nine year lease between the Public and Mr Justin Surcouf trading as Ormer & Scallops of Jersey Limited for the demised premises known as La Crête Quarry Shed, La Route de La Côte, St Martin at a starting rental of £4,000.00 a year.

2. Under Standing Order 168 (1) (a) and 168 (3) the Minister for Treasury and Resources hereby notifies the States that he has accepted the recommendation of Property Holdings to agree to the above land transaction.

The Minister hereby authorises Property Holdings to pass any contracts on behalf of the Public of Jersey that may be necessary.

After the expiry of 15 days following presentation to the States the transaction may be concluded.

Reason(s) for decision:

To allow the Lessee Mr Justin Surcouf trading as Ormer & Scallops of Jersey Limited security of tenure in order to invest in the facility for the provision of an Ormer hatchery to the Island

Under Standing Order 168 (1) (a) and 168 (3) the Minister is required to notify the States of his acceptance of recommendations to dispose, acquire, let or rent land on behalf of the public of Jersey.

Action required:

Director of Property Holdings to request the Greffier of the States to notify the States of the above decision.

Greffier of the States to notify Property Holdings of the date when the States has been notified.

After the expiry of 15 days following presentation to the States request the Property Holdings to pass any contracts on behalf of the Public of Jersey that may be necessary.

Purpose

To request the Treasury and Resources Minister to authorise the drafting and signing of a nine year lease agreement between the Public and Mr Justin Surcouf trading as Ormer & Scallops of Jersey Limited for the demised premises known as La Crête Quarry Shed situated at La Crête Quarry, La Route de La Côte, St Martin.

Background

On the 1 August 2005 Mr J Surcouf took occupancy of the demised premises known as La Crête Quarry Shed situated at La Crête Quarry, La Route de La Côte, St Martin under a licence agreement to establish an Ormer hatchery. The trial period has been shown to be successful and as such the hatchery is to remain and the agreement is to be continued in the form of a new lease.

Current Situation

Terms and conditions have now been agreed for the lease with Mr Justin Surcouf trading as Ormer & Scallops of Jersey Limited on the following basis

LESSOR - The Public of the Island of Jersey

LESSEE - Mr Justin Surcouf trading as Ormer & Scallops of Jersey Limited,

DEMISED PREMISES - La Crête Quarry Shed situated at La Crête Quarry, La Route de La Côte, St Martin

TERM - Nine years to be deemed to commence from 1 August 2006.

RENT - The starting rental shall be £4,000 per annum paid quarterly in advance.

RENT REVIEW - The rent will be subject to a Jersey Retail Price Index review on the third and sixth anniversary of this agreement.

PERMITTED USE - The demised premise is to be used for storage and as a hatchery and any change will be subject to Lessor approval which will not be unreasonably withheld or delayed.

REPAIRS & MAINTENANCE - The Lessee shall be responsible for full repair and maintenance of the demised premises including decoration with the Lessor being responsible for keeping it wind and water tight and structurally sound.

ALIENATION - Sub-letting of the demised premises is not permitted. Assignment may take place with the Lessor’s prior written consent which shall not be unreasonably withheld or delayed.

INSURANCE - The Lessor shall maintain in force a building insurance policy, the Lessee maintaining in force a business and contents insurance policy. The Lessee shall also maintain in force a Public Liability policy for not less than £2,000,000 (two million pounds) in respect of any one occurrence or other such sum as the Lessor may reasonably require from time to time.

OCCUPATION COSTS - The Lessee shall be responsible for all costs associated with the occupation of the demised premises excluding foncier rates.

LEGAL COSTS - Each party to pay their own legal costs in relation to this transaction.

Recommendation

It is recommended that the Minister supports the decision to enter into a nine year lease between the Public and Mr Justin Surcouf trading as Ormer & Scallops of Jersey Limited for the demised premises known as La Crête Quarry Shed situated at La Crête Quarry, La Route de La Côte, St Martin.
