Kerbside Recycling: Feasibility Study (P.121/2014): Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister for Transport and Technical Services decided to lodge “au Greffe” the amendment to P.121/2014.

Reason(s) for Decision:  Island wide kerbside recycling is an important waste management issue. Attempting to engage with numerous stakeholders and produce a quality feasibility study and recommendations by the end of 2014 is not believed to be achievable and it is intended to amend the date to the end of 2015.

Action required:  The Chief Officer of Transport and Technical Services to request that the Minister’s Amendment to P121/2014 be lodged “au Greffe” in time for the States debate scheduled for 14 July 2014.

P.121/2014 KERBSIDE RECYCLING FEASIBILITY STUDY

 

AMENDMENT OF THE MINISTER FOR TRANSPORT AND

 

TECHNICAL SERVICES

 

 

Purpose of the Report

 

This report sets out the proposed amendment to P.121/2014 Kerbside Recycling feasibility study.

 

 

Background

 

Deputy M Tadier of St Brelade has lodged P.121/2014 with regard to kerbside recycling.

SUMMARY OF PROPOSITION:

THE STATES are asked to decide whether they are of opinion –

 

to request the Minister for Transport and Technical Services, in liaison with the Parish Connétables, to investigate the feasibility of bringing forward a scheme for the Island-wide collection of household recyclables of selected materials (‘kerbside recycling’) and to report to the States with recommendations by the end of 2014.

 

Transport and Technical Services supports the intent of this proposition and would like to change the proposed timescales for delivering the recommendation as the investigation will require detailed liaison with numerous stakeholders and analysis of various delivery models.

 

The Minister is requested to approve an amendment to this proposition replacing the words “by the end of 2014” with “by the end of 2015”.

 

Recommendation

 

The Minister for Transport and Technical Services is requested to approve the attached Ministerial amendment to P.121/2014.
