Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

	Subject: Chief Minister’s delegation of functions to Assistant Ministers.
	Decision(s): The Chief Minister, acting in accordance with Article 28 of the States of Jersey Law 2005, agreed to delegate to his two Assistant Ministers, Senators Sir P.M. Bailhache P.F. Routier, responsibility for conducting external relations in accordance with the common policy agreed by the Council of Ministers as described in Article 18 (3) (b) of the States of Jersey Law 2005. The Chief Minister further agreed that both Assistant Ministers should be delegated authority to enter into Taxation Information Exchange Agreements (TIEAs) with other jurisdictions on behalf of the Chief Minister. The Chief Minister also agreed that his Assistant Minister, Senator P.F. Routier, should be delegated responsibility for the development of the Draft Control of Housing and Work (Jersey) Law 201- and Draft Register of Names and Addresses (Jersey) Law 201-, subject to any material amendments or decisions requiring the approval of the Chief Minister, and Council of Ministers as required, to include the lodging of any Proposition or presentation of any Report/comments, making of any statement, and the answering of questions in the Assembly on this matter (Standing Orders 9(3), 17(1)(a), 19(c), 35(1)(b).
	Reason(s) for Decision: Under Article 28 (1) of the States of Jersey Law 2005 a Minister may delegate, wholly or partly, functions conferred upon or vested in him to an Assistant Minister. Accordingly, following the appointment of his Assistant Ministers (MD-C-2011-0142) the Chief Minister wishes to delegate the above functions to them in order that they may assume responsibility of their respective areas of oversight, as described in the accompanying report.
