Appointed Day Act - Income Support Legislation.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision:

The Income Support (Jersey) Law 200- has been approved by the States and the scheme itself is due to be implemented in January 2008. The Income Support Regulations (P.90/2007) and the Income Support Special Payment Regulations are due for debate on 9 October 2007. The Appointed Day Act sets an appointed day of 28 January 2008 for the implementation of the Income Support Law and subordinate legislation.

Resource Implications:

The resource implications of introducing the Income Support scheme in 2008 are fully covered by the Department’s manpower and financial budgets for 2008.

Appointed Day Act - Income Support Legislation.

If adopted, this Act will bring into force the Income Support (Jersey) Law 2007, which was debated and approved by the States on the 10th October 2006, sanctioned by Order of Her Majesty in Council on 14th December 2006 and registered in the Royal Court on 12th January 2007.

The Income Support Law provides for a single means-related benefit system to replace a number of existing statutory and non-statutory benefits.

This proposition, if approved, will bring into force the Income Support (Jersey) Law 2007 and its associated subordinate legislation on the 28th January 2008, with the exception of Regulation 8 and Schedule 3 of the Income Support (Jersey) Regulations 2007 which will come into force on the same day as Article 6 of the Goods and Services Tax (Jersey) Law 2007. Regulation 8 provides for an increase in component rates following the introduction of the Goods and Services Tax.

Financial and manpower implications

The budget for the Income Support scheme is based on the amalgamation of existing benefit budgets and has been approved for 2008. Transfers of staff from the Housing Department (7 FTE) and the Parish of St Helier (11 FTE) to the Social Security Department have been agreed.
