Road Traffic (Public Parking Places - Miscellaneous Amendments No. 2) (Jersey) Order 2014

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENTS NO 2) (JERSEY) ORDER 2014

 

 

Purpose of the report

 

To request the Minister to make the Order to introduce the previously approved Les Jardins Car Park and D’Auvergne School Car Park and amend the maximum stay period at La Cimitiere Car Park in St Brelade.

 

 

Discussion

 

The Minister for Transport and Technical Services approved the following changes to the Road Traffic (Public Parking Places) (Jersey) Order 2006:

 

On 31 January 2104 the Minister for Transport and Technical Services approved a request to add D’Auvergne School Car Park with a maximum stay period of 12 hours in any continuous 24 hour period at the request of the Education, Sport and Culture Department. Ministerial Decision MD-T-2014-0009 relates.

 

On 21 February 2014 the Minister for Transport and Technical Services approved a request to add Les Jardins Car Park with a maximum stay period of seven consecutive days and to allow overnight parking for commercial vehicles over 15 foot in length. Ministerial Decision MD-T-2014-0012 relates. Les Jardins Car Park is also added to the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2010 as a car park where Season Tickets can be used.

 

On 28 March 2014, the Minister for Transport and Technical Services approved a change to the maximum stay period allowed in La Cimitiere Car Park in St Brelade from a maximum 12 hour in a continuous period of 24 hours to a maximum stay of three hours in a continuous 24 hour period with a requirement to display an arrival time using a valid parking disc at the request of the Connétable of St Brelade. Ministerial Decision MD-T-2014-0028 relates.

 

 

Recommendations

 

The Minister is recommended to approve the Road Traffic (Public Parking Places – Miscellaneous Amendments No 2) (Jersey) Order 2014 to be effective seven days after signing.
