Beach/Marine New Trading Concession: Le Braye, St. Brelade and Bel Royal, St. Lawrence

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the application from Windmadness Limited to set up a new beach / marine  trading concession from the beach at Le Braye, St Brelade and Bel Royal, St Lawrence.  

Reason(s) for Decision:

Under the Policing of Beaches (Jersey) Regulations 1959, regulation 3 (1)(d), a person requires written permission from the Minister to engage in trading on the beach.  Following an application from Windmadness Limited to set up a new beach / marine concession from the beach at Le Braye, St Brelade and Bel Royal, St Lawrence, and on receipt of the necessary approval from the Constables of St Brelade and St Lawrence and in this case the Pilotage & Enforcement Manager at Jersey Harbours the Minister gave his permission for this application to proceed.

Resource Implications:

Additional financial income generated, no human or additional resource implications.

Action required:

The Hospitality and Leisure Manager to notify Windmadness Limited, Constable of St Lawrence, Constable of St Brelade and Jersey Harbours that permission has been granted by the Minister.

Ministerial Decision

 

Policing of Beaches (Jersey) Regulations 1959

 

 New beach / marine trading concession, from the beach at Le Braye, St Brelade, and Bel Royal, St Lawrence.

 

Under the Policing of Beaches (Jersey) Regulations 1959, regulation 3 (1)(d), a person requires written permission from the Minister to engage in trading on the beach.

 

In response to an application from Windmadness Limited to operate a new beach / marine concession, based at Le Braye and Bel Royal, a consultation process was undertaken.

 

In an attempt to gauge opinion and seek support or objection the Constables of St Brelade and St Lawrence were consulted.  A full consultation was also made with Jersey Harbours as the marine element of the operation would require its full consent and regulatory licensing.     

    

Whilst this is an application to operate and trade from the beach the main objective of the operation is marine based.  The proposed activities and trading locations are listed below

 

The proposed undertaking will include the following activities:

 

  • The hire of kite surfing / boarding equipment to locals or visitors subject to the presentation of a International Kite Boarding Organisation or British Kite Surfing Association membership or certification. Hire of equipment will also be subject to a visual competency assessment. 

 

  • The tuition of kite surfing/boarding for those with pre booked lessons

 

  • The tuition of kite surfing/boarding for any beach user wishing to experience the sport for the first time – 30 minute sessions for a fee of £15.00. Additional longer sessions will be available.

 

  • The hire of standard conventional kites for children and adults.

 

  • The hire and tuition of stand up paddle boards

 

The proposed beach locations of the undertaking:

 

  • On the beach 150 yards North on Le Braye Slipway adjacent to the sea wall in an area sufficient to teach eight students at a time.

 

  • On the beach 100 yards west Bel Royal slipway adjacent to the sea wall in an area sufficient to teach eight students at a time.   

Recommendation

 

Following receipt of the consultation responses from the relevant Parishes and Jersey Harbours the Minister granted the application, subject to the conditions outlined below.

 

In addition to the usual terms and conditions which accompanies all beach trading concessions the following conditions will also apply –

 

  • This concession is granted on a trail period of one year and is subject to any feedback which we may receive from the general public, Parishes, Harbours and any other authority.

 

  • All necessary licenses’ are obtained and all recommendations made by Harbours are adhered too.

 

  • Comply with the International Kite Boarding Organisation code of conduct by keeping any other water/beach users in clean vision, staying well upwind 400meters ++, or downwind of them 300mtrs ++.
