Transfer of budgets etc. between Home Affairs and Property Holdings.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

  1. The Minister agreed to transfer four current property related projects with their associated budgets totalling £8,712,700, along with their total expenditure to date, from the Home Affairs Department to the Property Holdings Department.
  2. The Minister agreed that all future property related capital projects for Home Affairs should be carried out by the Property Holdings Department.

Reason(s) for decision:

The decision of the States in June 2005 to create a Property Holdings Department to be responsible for the administration, maintenance and development of all States Property.

Action required:

For officers to transfer the budgets and balances as per the decision.

REPORT TO THE MINISTER FOR TREASURY AND RESOURCES

Transfer of Capital Projects from the Home Affairs Department to the Property Holdings Department.

Purpose of the Report

To seek the approval of the Minister to transfer four current capital projects named below, plus all future property capital projects for the Prison from the Home Affairs Department to the Property Holdings Department.

Background

In June 2005 the States agreed to the creation of a new property holdings department to be responsible for the administration and maintenance of all States property with the exception of social rented housing and property owned by the trading departments.

The Property Services and Public Buildings functions of the Transport and Technical Services Department, the Education Maintenance Department and the non social rented land and property from the Housing Department have already been transferred. It is now proposed that the following capital projects from the Home Affairs Departments are transferred with effect from 1st February 2007.

It is also proposed that all future property related projects should be carried out by the Property Holdings Department working with the relevant Officers in Home Affairs.

Recommendation

The Minister is recommended to accept the proposed total budget transfer of £8,712,700 for the transfer of the four capital projects named above and that future Prison property related projects should be carried out by the Property Holdings Department.
