Temporary amendment to the Road Traffic (St Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002, in accordance with Article 68 of the Road Traffic (Jersey) Law 1956.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO PARKING RESTRICTIONS IN

LA MOTTE STREET ST HELIER

Purpose of the report

To make a temporary amendment to the Road Traffic (St Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 under the Road Traffic (Jersey) Law 1956.

Background

As part of the Urban Task Force Programme for improvements to St Helier streets, changes to the parking restrictions in La Motte Street will be necessary.

Discussion

Article 68 of the Road Traffic (Jersey) Law 1956 enables changes to Traffic Orders to be made, for a period of up to 12 months, without waiting for the relatively lengthy process of amending Orders to be completed.  During the 12 month period an amendment to the Order will be drafted, for approval by the Minister.

The changes to the on-street parking restrictions in La Motte Street comprise:

  1. The removal of all parking to the west of Hilary Street
  2. The shortening of the unloading period in the unloading bay at Snow Hill to enable “Al Fresco” facilities to be established from 11 a.m.
  3. The reduction of paycard parking from three to two spaces and the introduction of two disabled spaces (to replace those lost further west) to the east of Hilary Street

The Connétable of St Helier and the businesses in the immediate area have been consulted and are in agreement with these changes.  The temporary changes made by the notice must be incorporated into the Road Traffic (St Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 within 12 months of the date of the notice, by subsequent Ministerial Decision.

Recommendation

The Minister is recommended to approve the attached notice, as required by Article 68 of the Road Traffic (Jersey) Law 1956, to come into effect on Monday 20th April 2009.

Reason for Decision

To make changes to on-street parking and loading restrictions in La Motte Street, St Helier to allow La Motte Street Urban Renewal improvement works to be completed.

Action Required

The Minister to instruct his officers to arrange for a notice to be inserted in the Jersey Gazette, as required by Article 68 of the Road Traffic (Jersey) Law 1956, on two occasions during the seven days immediately preceding the date on which it is to have effect.
