Shipping (Miscellaneous Provisions No. 2) (Jersey) Order 2012 International Convention for the Prevention of Pollution from Ships (MARPOL)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister made the Shipping (Miscellaneous Provisions No. 2) (Jersey) Order 2012. (“the Order”).

Reason(s) for Decision:

The States adopted the Shipping (MARPOL) (Jersey) Regulations 2012 on 17 January 2012. As a result, the UK ratified the International Convention for the Prevention of Pollution from Ships (MARPOL) on behalf of the Island on 30 July 2012. The ratification automatically brought the Regulations into force.

The Order overcomes an overlap between the prohibition on the discharge of oil set out in the Shipping Law and the prohibition (and exceptions) relating to similar discharges in Annex I to the Convention; it extends the operation of certain provisions of the legislation to fixed or floating platforms, so that they meet the same pollution restrictions as ships and it amends Regulation 1 to correctly define the International Maritime Organization (IMO) by using its modern title.

Explanatory Note

The objects of this Order are 

(a) in Article 1 to avoid an overlap between the prohibition on the discharge of oil set out in Article 98(1) of the Shipping (Jersey) Law 2002 and the prohibition (and exceptions) relating to similar discharges within the terms of Annex I to the International Convention for the Prevention of Pollution from Ships, 1973 (known as the MARPOL Convention) and Regulation 13 of the Shipping (MARPOL) (Jersey) Regulations 2012;

(b) accordingly, by virtue of Article 1, to allow that Annex and those Regulations to govern those discharges;

(c) in Article 2 to extend the operation of certain provisions of the Shipping (Jersey) Law 2002, and all of the Shipping (MARPOL) (Jersey) Regulations 2012, to platforms that float or stand in the sea, so that those platforms have to meet the same pollution restrictions as ships and are subject to the same supervision under Parts 10, 11 and 12 of the Shipping (Jersey) Law 2002; and

(d) in Article 3 to amend Regulation 1 of the Shipping (MARPOL) (Jersey) Regulations 2012 by omitting the definition of “IMO” (a term which is in fact not used in those Regulations) and by changing the definition of “Organization” so that the definition will refer to the International Maritime Organization (that is, the IMO) and not its predecessor.

Article 4 sets out the short title of the Order and provides for it to come into force on the seventh day after it is made.
