List as Site of Special Interest: Bulwark Cottage, Le Mont du Boulevard, St. Brelade.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined that Bulwark Cottage, Le Mont du Boulevard, St. Brelade be added to the List of Sites of Special Interest.

Reason(s) for Decision:

  1. The special interest of Bulwark Cottage, Le Mont du Boulevard, St. Brelade as defined and in the schedule and relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002 and; it accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets.
  2. Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 enables the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attaches to the building or place

Legal and resource Implications:

The Minister is empowered to add buildings or places to the List of Sites of Special Interest where he is satisfied they have public importance, having considered all relevant material considerations as set out in the Law. In adding a building or place to the List the Minister is then able to control certain operations not amounting to development in order to protect the special interest of the building or place.

Purpose of the Report

To seek to confirm the Minister’s intention to add Bulwark Cottage, Le Mont du Boulevard, St. Brelade to the List of Sites of Special Interest. 

Background

The Minister previously considered a report on the matter prepared by Jersey Heritage dated 1st October 2008 and determined that this building and place was of sufficient interest to warrant its addition to the List of Sites of Special Interest. A notice of Minster’s intent to add this site to the List was served on the owner of the property on 24th November 2008 in order to provide an opportunity for representations to be made. 

The owners sent the representations via a letter dated 20th November which is attached. 

Discussion and recommendation

The owners support the principle of protecting Jersey’s historic buildings but raise particular concerns with regard to the potential implications of being able to alter the property in the future, should it be Listed. Whilst clearly of concern to them, this is not material to deciding whether or not the building has intrinsic value and interest, and proposals for change can only be properly considered within the context of any subsequent application. 

On the basis of the building’s architectural and historical interest, it is recommended that the Minister for Planning and Environment adds Bulwark Cottage, Le Mont du Boulevard, St. Brelade to the List of Sites of Special Interest
