Notice of Intention to List as Site of Special Interest

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (01.08.06) to approve the serving of the Intention to List Notices for several Forts and Towers as Sites of Special Interest.

on the List of Sites of Special Interest by reason of their special interest as defined in the schedules attached to the report, under the provisions of the Planning and Building (Jersey) Law 2002; and;

2. approve the serving of the Intention to List Notices for each of these sites in accord with the requirements of the law.

Reason(s) for decision:

The proposal accords with the States Strategic Plan commitment of protecting and sympathetically managing our built heritage assets.

Action required:

1. Intention to List Notices to be served in accord with the requirements of the law;

2. No sooner than 28 days after the date of the service of the Intention to List Notice, a further report will be brought back to the Minister relative to any representations received.

Forts and Towers

Purpose of the Report

The purpose of this report is for the Minister to re-affirm the previous decision of the Environment and Public Services Committee to issue notices of intent to List eight sites under the Planning and Building (Jersey) Law 2002 as Sites of Special Interest.

Background and discussion

The Environment and Public Services Committee previously determined to designate the following eight sites as Sites of Special Interest under the former Island Planning (Jersey) Law, 1964, as amended.

  MP2 Observation Tower, Corbiere

  Lewis's Tower, St Ouen

  L'Etacquerel Fort, Trinity

  La Crete Fort, St John

  Icho Tower, St Clement

  Archirondel Tower, St Martin

  Fort Leicester, Trinity

  Seymour Tower, Grouville

The sites, their locations, descriptions and the basis of their special interest is described in the attached appendices. These sites are all within public ownership and are part of the Forts and Towers Project to repair and refurbish them as holiday lets. It is important that the sites are protected under law to ensure that their historic fabric is safeguarded.

As required under the law, notices of intent were issued but the designation process did not proceed further.

With the advent of the new Planning and Building (Jersey) Law 2002 on 01 July 2006, the former notices, served under the 1964 Law, are effectively invalid. On this basis, the notices have been re-drafted under the provisions of the new law.

Recommendation

On the basis of the above, the Minister for Planning and Environment is recommended to;

1. approve the proposal to include the building and places set out below:

i. MP2 Observation Tower, Corbiere

ii. Lewis's Tower, St Ouen

iii. L'Etacquerel Fort, Trinity

iv. La Crete Fort, St John

v. Icho Tower, St Clement

vi. Archirondel Tower, St Martin

vii. Fort Leicester, Trinity

viii. Seymour Tower, Grouville

on the List of Sites of Special Interest by reason of their special interest as defined in the attached schedules, under the provisions of the Planning and Building (Jersey) Law 2002; and;

2. approve the serving of the Intention to List Notice in accord with the requirements of the law.
