Les Cinq Chenes - Leasing of land to Jersey Electricity Company for a new Sub-Station

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

REPORT TO THE HOUSING MINISTER

 

PROPOSED LAND LEASE TO THE JERSEY ELECTRICITY COMPANY TO ALLOW FOR THE UPGRADING OF MAINS ELECTRICITY SUPPLY

AT LES CINQ CHENES

 

Les Cinq Chenes is a large family estate comprising 110 houses and 27 flats. The majority of these homes are heated with wet heating systems fuelled by a communal oil tank and underground pipes, these feed aging externally mounted boilers on each house. The plant on this site is now at an age where replacement is necessary and in doing so it is the Departments policy to replace with sustainable systems which offer customers good heating standards at an affordable price.  The Department is also committed to reducing carbon emissions wherever possible. In order to achieve these objectives the existing heating systems with a night storage based electric heating and hot water system utilising the JEC’s Comfort Heating tariff.

 

However, the current supply of electricity to this site is inadequate to cope with the increased demand necessitated by the switch of heating type.  It is proposed that a new JEC substation and distribution pillar be constructed on site as shown on the attached site plan.  This will require the land on which the substation is to be built to be leased to the Jersey Electricity Company for a consideration of £990.00 for a period of 99 years.  This arrangement is consistent with existing arrangements elsewhere.  In addition, the JEC will require way-leave agreements for the substation, distribution pillar and cable routes.  The location of the sub station, distribution pillar and route of the cables are shown on the attached site plan.

 

Recommendation

 

That the Minister:-

 

  1. approve the lease of the land as depicted on the attached site plan to the JEC for 99 years for a consideration of £990.00

 

  1. request that the Treasury & Resources Minister approve the transaction in accordance with Standing Order 168,  seek the approval of the States for the transaction and authorises the Greffier and Attorney General to sign the necessary contracts on behalf of the Public.
