17 - 19 Devonshire Place, St. Helier - Proposed Sale.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): 

1. The Minister approved, as recommended by Property Holdings, the transfer of administration of 19 Devonshire Place from Property Holdings to the Housing Department and having noted the comments in the report, accepted the recommendation of the Minister for Housing for the sale of 17 and 19 Devonshire Place, St Helier to Mr Michael John Neville and Mrs Maureen Neville née Parsons at the full asking price of £200,000 and £225,000 respectively, as approved in MD-H-2007-0076 dated 25 October 2007. 

2.  Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.

Reason(s) for Decision: 

Under Standing Order 168 (1) (a) and 168 (2) (a) and (b) the Minister is required to accept the recommendation of a body established by the States to manage land and buildings owned by the public of Jersey in respect of the disposal of land.

Resource Implications: 

The Housing Department will receive a capital receipt as identified, whilst foregoing a rental in respect of the above property. The resultant funds will be directed to HYC029.120410.

Action required: 

1. The Director of Property Holdings is to instruct the Attorney General and the Greffier to pass the necessary contract, and to copy this decision to the Minister, Treasurer and Deputy Treasurer.

Property Transaction for Ministerial Decision - Minister for Treasury and Resources  

17 & 19 Devonshire Place, St Helier – Proposed Sale

AV 11/857 & 15/856  

Purpose  

To seek approval from the Minister to the transfer of administration of 19 Devonshire Place from Property Holdings to the Housing Department and the sale of 17 and 19 Devonshire Place on the open market. 

Background  

On 17 July 2007 the States approved P6.2007 The Social Housing Property Plan 2007-2016. That decision empowered the Housing Department to sell a number of non-core properties on the open market. On 25 October 2007 the Minister for Housing approved MD-H-2007-0076 for the sale of 17 and 19 Devonshire Place. 

Current Situation  

The Minister for Housing seeks the acceptance of the Minister for Treasury and Resources to the transfer of administration and to the terms and conditions which have been agreed between the Housing Department on behalf of the Public and the prospective purchaser. 

The market valuation of 17 Devonshire Place was placed at £200,000 and £225,000 for 19 Devonshire Place. The prospective purchasers Mr Michael John Neville and Mrs Maureen Neville née Parsons have offered the full asking price and are cash purchasers with no onward chain. 

The parties will pay their own costs in relation to this transaction. 

Recommendation  

It is recommended that the decision of the Minister for Housing is accepted.
