Amendments to the Road Traffic (St John) (Jersey) Order 1982.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Road Traffic (St John) (Jersey) Order 1982: amendment.

Decision(s):   The Minister, having resolved to make a section of La Route du Nord subject to a prohibition of waiting restriction, on its east side, from the exit road of the St John’s Village Precinct, for a distance of 18 yards north, agreed that the Law Draftsman should be instructed to prepare the necessary amendment to the Road Traffic (St John) (Jersey) Order 1982 on the basis of a brief to be provided by the Department.

Reason(s) for Decision: To protect visibility for vehicles emerging onto La Rue du Nord from St John’s Precinct.  

Resource Implications: Law drafting time. Transport and Technical Services Department time.

Action required:  To instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.

TRANSPORT AND TECHNICAL SERVICES  

REQUEST FROM THE PARISH OF ST JOHN FOR AN AMENDMENT TO THE ROAD TRAFFIC (ST JOHN) (JERSEY) ORDER 1982  
 
 

Purpose of the Report  

To amend the Road Traffic (St John) (Jersey) Order 1982 
 

Background  

Vehicles, particularly heavy goods, frequently park on La Rue du Nord immediately north of the exit from St John's Precinct, reducing the visibility of vehicles exiting onto La Rue du Nord and thereby causing a hazard. 

The Connétable of St John has requested TTS to consider the construction of a lay-by on La Route du Nord so that vehicles can park without impeding visibility.  This would require removal of a road side footpath, excavation into a grass bank along the road side for a distance of approximately 40m and road construction of approximately 100m². 
 

Discussion  

The Department has no identified budget for these suggested works and officers have therefore advised the Connétable that in the first instance a prohibition of waiting should be applied to prevent vehicles parking close to the junction with the precinct.  The situation will be monitored to gauge its effect. 
 

Recommendation  

The Minister is recommended to approve the proposal to apply a prohibition of waiting line and to amend the Road Traffic (St John) (Jersey) Order 1992 accordingly.
