Jersey Competition Regulatory Authority: Appointment of Chief Executive

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Appointment of the Chief Executive of the Jersey Competition Regulatory Authority the JCRA board.

Decision(s): The Minister appointed Mr Andrew Riseley as Member of the Board of the Jersey Competition Regulatory Authority in accordance with Article 3(1)(b) of the Competition Regulatory Authority (Jersey) Law 2001.

Reason(s) for Decision: Mr Riseley has been appointed as Executive Director of the Authority and by virtue of that post requires the approval of the Chairman of the Authority and the Minister to be appointed to the Board.

Resource Implications: The JCRA is funded by licence fees and a fixed competition law grant, so this appointment will have no resource implications for the States. This position is part funded by the Guernsey Competition Regulatory Authority under the agreement to jointly operate as the Channel Islands Competition Regulatory Authority.

Action required: The Strategy Manager to contact the Publications Editor at the States Greffe in order to present the attached report to the States to inform the Assembly of the appointment in line with the provisions of Article 3(3) of the Competition Regulatory Authority Law.

Jersey Competition Regulatory Authority: Appointment of Chief Executive

Report to be presented to the States by the Economic Development Minister

 

Appointment of Andrew Riseley to the Board of the JCRA under Article 3(1)(b) of the Competition and Regulatory Authority (Jersey) Law 2001.

 

Following the announcement of the current Chief Executive of the JCRA that he intends to step down, that post is to become vacant as part of a managed transition.

 

The recruitment process

 

The post has been advertised in both the local media and internationally, and applications were received from both local and overseas applicants. A Panel consisting of the Chairman and two Non-Executive Directors of the JCRA together with a member of the Jersey Appointments Commission considered the applications.

 

The Panel interviewed a shortlist of candidates comprising both internal and external applicants, and appointed Andrew Riseley, the current Deputy Executive Director of the JCRA, to the position. As part of his role as Chief Executive, Mr Riseley will be expected to sit on the Board of the Authority and the Minister for Economic Development has approved this appointment.

 

The successful candidate

 

Mr Riseley is a competition and regulatory lawyer, who has worked at large law firms in both the UK and Australia, at one of the UK's competition regulators, and in-house at a major UK utility. He has extensive experience in utility regulation, competition law (merger control, abuse of dominance and horizontal and vertical agreements) and public procurement.

Mr Riseley joined the JCRA as Deputy Executive Director in July 2011. Prior to joining he was an associate director at Berwin Leighton Paisner LLP, a law firm based in the City of London, and advised a number of regulated utilities in sectors such as water, electricity and gas.  Prior to joining BLP, Mr Riseley was the in-house competition and regulatory lawyer at Thames Water in Reading, UK.  Mr Riseley was previously a legal advisor at the UK Competition Commission, where he worked on inquiries into grocery retailing and airport price controls. He began his legal career in the competition departments of the law firms Clifford Chance LLP in London and Mallesons Stephen Jaques in Melbourne, Australia.

Mr Riseley is admitted to practise as a solicitor in England and Wales and Victoria, Australia. He holds post-graduate qualifications in competition law and economics from the London School of Economics and Political Science where he studied as a Commonwealth Scholar in 2001/02, and degrees with first-class honours in economics and law from Monash University in Australia.
 

Mr Riseley is to be appointed as Chief Executive on 13th June 2012, and the Minister duly appoints him to the board of the JCRA from this date.

 

Inter-Island cooperation

 

As well as his appointment as Chief Executive of the JCRA, Mr Riseley is simultaneously being appointed as Chief Executive of the newly-formed Guernsey Competition Regulatory Authority. This will reduce the cost of the position by sharing expenses and salary with Guernsey and allow greater co-operation between the two islands on competition matters under the banner of the Channel Islands Competition Regulatory Authority.

 

Reporting

 

Under Article 3(3) of the Competition Regulatory Authority (Jersey) Law 2001 the Minister for Economic Development is required to notify the States of appointments of members of the Jersey Competition Regulatory Authority (JCRA).
