Revenue to Capital Budget Transfer: Education Sport and Culture

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Revenue to Capital budget transfer for mobile youth vehicle.

Decision(s): The Minister for Education, Sport and Culture approved the 2009 budget transfer of Revenue funds amounting to £68,000 to Capital, in order to meet GAAP requirements for the purchase of a vehicle to act as a mobile youth centre for the island.

Reason(s) for Decision: The funds for the purchase of the Youth Service minibus which are currently included in revenue budgets are required to be transferred to capital to comply with GAAP requirements

Resource Implications: There are no other financial or manpower resource implications.

Action required: For officers of the Department to request the approval of the Treasurer of the States to the transfer in accordance with Financial Direction 3.6

  1. Purpose of Report

For the Minister for Education, Sport and Culture to approve the following revenue to capital transfer in order to comply with GAAP requirements:-

£68,000, representing the money required to part-finance the purchase of a vehicle to act as a mobile youth facility for the island as a whole. 

  1. Background

The Department has been successful in establishing a Contingency Fund which can be drawn on in the future to meet unforeseen and unavoidable costs which inevitably arise from time to time. SMT has agreed to allocate a sum of £60,000 to the Youth Service in 2009, to compensate for a contribution which the Service made to the costs of Mont a l’Abbe School in 2008.  This money is equivalent to 88% of the purchase. The balance of the purchase cost was generated by the Youth Service from donations and sponsorship, this will be transferred into the Youth Service and the entire transfer to capital will take place from a revenue account.  There are no other manpower or cost implications, both staffing and maintenance costs have been identified from the current resources allocated to the Youth Service.

Under Financial Direction 3.6 para 5.7, the approval of the Treasurer of the States is required for transfers up to £100,000.

A Capital Asset Replacement Programme is in the process of being developed. This will ensure that the Department has a structured schedule of future asset purchases and disposals. Whilst several options are available, a centrally run system, a devolved system, or some form of hybrid,  it will be essential that all relevant parties are canvassed to ensure that the solution is both efficient and robust for the purpose of planning for the purchase/replacement of assets.  All strategies will be considered and a proposal put to ESC SMT before being implemented.

  1. Recommendation

That the Minister for Education, Sport & Culture approves the transfer of £68,000 from revenue to capital to fund the purchase of the Youth Service minibus.
