Public Waste Oil: Change of measured unit from litres to kilograms

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Revision of public waste oil chargeable quantities.

Decision(s):  The Minister approved the proposal that public waste oil chargeable quantities be measured in kg mass and the unit of measure be displayed on the public information charging sheet.

 

Reason(s) for Decision:  To comply with the Weights and Measures (Jersey) Law 1967 the unit of measurement be changed from litres (l) to kilograms (kg) when charging for a delivery of public waste oil. This change negates the operational need to convert the mass and density of a potentially mixed fluid, in order to calculate the volume of fluid. The new charge per kg of waste oil or chemical is £0.43 per kg.

 

Resource Implications:  There will be no resource implications as the minor cost reduction in the charge is made up by the improved handling process.  Signage cost covered from the existing budget.

 

Action required:  Notify the general public of the revised charging category and value.

rEVISION OF PUBLIC WASTE OIL CHARGing QUANTITIES
 

 

Purpose of Report

 

To enable the Minister for Transport and Technical Services to approve the new waste oil charging quantities.

 

 

Background

 

To comply with the Weights and Measures (Jersey) Law 1967 and remove any ambiguity regarding the quantity of waste oils being deposited for recycling, the measurement of all recycled oils will be in kilograms (kg).

 

This change negates the operational need to convert the mass and density of a potentially mixed fluid, in order to calculate the volume of fluid.

 

This change of charging process speeds up the handling of the product and as such saves money for the department and as such the price of the oil will be left at £0.43 per unit.

 

Previous charge for waste oil = £0.43 per litre (1st June 2011)

 

The new charge per kg of waste oil or chemical is £0.43 per kg.

 

New pallet scales that have been approved and checked by Trading Standards will be used to calculate the weight of the waste oil and local signage will be erected to inform the general public of the new charging category

 

                              

Recommendation

 

That the Minister approves the new waste oil charging quantity and accordingly the new charge of £0.43 per kg of waste oil.
