Road Traffic (Public Parking Places) (Amendment) (Jersey) Order 2009

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Road Traffic (Public Parking Places) (Amendment) (Jersey) Order 2009 – Inclusion of Seymour Tower Car Park

Decision(s): The Minister made the Road Traffic (Public Parking Places) (Amendment) (Jersey) Order 2009, to become effective seven days after it is made, the purpose of which is to add a new car park by:

1.  Allowing the addition of Seymour Tower Car Park to the Order

2.  To place a restriction on waiting there of a maximum of 12 hours in any continuous 24 hour period

Reason(s) for Decision: At the request of The Environment Department to amend the Road Traffic (Public Parking Places) (Jersey) Order 2006.

Resource Implications: Law drafting time. Production and installation of new signage by Environment Department £300.  None for Transport and Technical Services Department.

Action Required: To send the hard copy of the Order to the Publications Editor at the States Greffe as soon as it has been signed.

ROAD TRAFFIC (PUBLIC PARKING PLACES) (AMENDMENT) (JERSEY)

ORDER 2009 – INCLUSION OF SEYMOUR TOWER CAR PARK

 

Purpose of the Report

To add Seymour Tower Car Park to the Public Parking Places (Jersey) Order 2006.

 

Discussion

On 16 January 2009, the Minister approved a request from the Environment Department for the addition of Seymour Tower Car Park to the Road Traffic (Public Parking Places) (Jersey) Order 2006 under Ministerial Decision MD-T-2009-0002.

The Environment Department has recently taken ownership of this area and in order to enable Parking Control to administer the car park it has been scheduled in the Road Traffic (Public Parking Places) (Amendment) (Jersey) Order 2009.

The Environment Department has also requested that a maximum stay period of 12 hours in any continuous period of 24 hours be applied to this car park.

Recommendations

The Minister is requested to approve the Amendment to be effective from seven days after the Order is made.
