Central Market - Flooring.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

To determine application for SSI consent for new flooring to the Central Market.

Background

The application was reviewed by the Planning Applications Panel at its meeting of 22 February 2006. Following a site visit members voted 2 to 1 in favour of the application, contrary to the Officer recommendation. The application is, therefore, to be referred to the Minister for determination.

Discussion and recommendation

Having regard to the earlier officer recommendation, which is maintained, and the Minister’s visits to the site to see the test panel and to have regard to the setting, context and character of the market, the Minister is recommended to REFUSE the application.

Summary/

Conclusion

The proposed re-flooring of the Central Market constitutes part of an ongoing programme of improvement works being undertaken by the applicant. The original concrete floor of the market has, in the past, been damaged by the installation of drainage and services. A programme of renewal and maintenance to the drainage and services systems is currently underway; this will cause further damage to the historic flooring. The applicant has also expressed concerns that, due to both its inherent properties and the lack of surface drainage, the existing floor is difficult to clean to an acceptable standard. It can also become slippery in certain conditions, placing members of the public at risk.

It is not intended to ‘grub up’ the existing floor; the new flooring material is to be laid over the existing throughout the pedestrian routes of the market only (i.e. not beneath the areas of the stalls). The proposed material is a monolithic reactive resin flooring system which has been widely used throughout the world in modern large scale public projects such as airports, sports stadiums and the like. The surface finish is slightly rough in texture and it is light reflective. The material is available in various colours; a sample of that proposed will be tabled at the meeting.

It should be noted that the material is monolithic; therefore any future alteration, renewal or repair to below ground services will cause ‘scarring’ to the finished floor.

The Central Market is a fine example of a traditional Victorian market and as such forms an important part of St Helier’s public realm; an area where

It is considered that the physical and visual properties of the proposed flooring will harm the fabric and character of this Site of Special Interest.

Summary of Representations

Following publicity about the project in 2004 the Société Jersiaise, by letter dated 12 August 2004, expressed opinion that the existing granite paving in the north arcade and the ‘Pork Market’ should be retained. (copy attached).

The current proposal shows that all areas of existing granite paving are to be retained.
