A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved and agreed to lodge ‘au Greffe’ the appended Report and Proposition proposing that 100% of the Channel Islands Lottery Jersey profits for 2012 be awarded to the Association of Jersey Charities.
Reason(s) for Decision: The Minister is required by Regulation 4(5) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975 to ask for States approval to distribute unallocated lottery profits.
Resource Implications: Subject to States’ approval, 100% of the Jersey profits from the Channel Islands Lottery in 2012 will be transferred as soon as is reasonably practicable to the Association of Jersey Charities. There are no manpower implications.

ALLOCATION OF PROFITS FOR 2012

Proposition

THE STATES are asked to decide whether they are of opinion –

To agree, in accordance with the provisions of Regulation 4(5) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975, that all monies standing to the credit of the Channel Islands Lottery (Jersey) Fund which have not already been set aside by the Minister (representing 100% of the total Jersey portion of the profits of the Channel Islands Lottery for 2012) should be paid to the Association of Jersey Charities for the benefit of the community and the charitable needs of the Island.

REPORT

The decision making process for allocating funds from the Channel Islands Lottery is that the Minister has responsibility for establishing a reserve, but the States is responsible for the distribution of remaining funds that constitute the Lottery’s ‘profit’. Accordingly the Minister for Economic Development, pursuant to his powers under Regulation 4(5) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975 and in consultation with the Association of Jersey Charities, has agreed not to withhold a percentage as a reserve for 2012. Both Economic Development and Treasury are satisfied that the current reserve is sufficient for the purpose it is maintained.

The profit from 2012, according to the provisions of the Regulation, is to be applied “in such manner and for such purposes of public benefit as the States shall from time to time by Act direct”. It is the Minister’s recommendation to the States that 100% of these funds be granted to the Association of Jersey Charities.

The Association now represents over 280 member charities and undertakes a valuable function by considering and allocating funding to the best prepared and worthy projects put forward by its members. In doing so, the Association continues to fulfil a vital social need.

During 2012 work continued on modernising and improving the Channel Islands Lottery in Jersey. The programme of modernisation will be enhanced in 2013 with the appointment of a partner organisation to take over the day to day operation of the Channel Islands Lottery with the aim of driving increased sales and, therefore, revenue for local good causes.

Financial and manpower implications

Subject to States’ approval, 100% of the Jersey profits from the Channel Islands Lottery in 2012 will be transferred as soon as is reasonably practicable to the Association of Jersey Charities. There are no manpower implications.
