Westmount Quarry, Westmount Road, St Helier: Redevelopment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Westmount Quarry (Former Parish Depot.), Westmount Road, St. Helier.  

Redevelopment of former parish depot and disused quarry to provide 206 residential apartments including 16 sheltered apartments, plus 60 bed nursing home and associated facilities, 60 place pre-school nursery and associated facilities, ground floor commercial unit, basement and covered ground level parking for 281 vehicles with associated plant and refuse areas. Alterations to existing vehicle entrance. Creation of new ground level public space to include improved access to protected cemetery, new landscaped residential amenity spaces and re-grading, stabilisation and re-planting of existing quarry faces. AMENDED PLANS: (Redesign of Block A) Redevelopment of former parish depot and disused quarry to provide 196 residential apartments including 16 sheltered apartments, plus 60 bed nursing home and associated facilities, 60 place pre-school nursery and associated facilities, ground floor artists studio units, basement and covered ground level parking for 281 vehicles with associated plant and refuse areas. Alterations to existing vehicle entrance. Creation of new ground level public space to include improved access to protected cemetery, new landscaped residential amenity spaces and re-grading, stabilisation and re-planting of existing quarry faces.  ADDITIONAL INFORMATION: Visual Impact Review and solar path analysis of Block D in relation to Park Heights.

Decision(s):

The Minister received the Department’s Report providing an up-date from the public Ministerial Meeting on 7th April and resolved to approve planning permission, subject to the conditions set out in the Department’s Report and one further condition requiring: 

“Prior to first occupation, all residential apartments shall achieve a Level 3 Sustainability Rating as set out in the Code for Sustainable Homes (Communities and Local Government, December 2006) or similar Standard to be first approved by the Minister for Planning and Environment.

Reason: To achieve a high standard of sustainable development and to comply with Policy G1 of the Jersey Island Plan 2002.”

Reason(s) for Decision:

Permission has been granted, subject to the conditions as specified, having taken into account the relevant policies of the approved 2002 Island Plan, together with other relevant policies and all other material considerations, including the consultations and representations received. A small part of the application site is designated as Important Open Space in the 2002 Island Plan, but the Minister considered that this was an insubstantial departure from the Plan given the contribution the development would make towards meeting the Island’s housing needs within the Built-Up Area.
